Isn't the rural area a local hukou that can inherit the house and land at home?

You can't. Up to now, there is no clear and specific legal provision on whether children whose registered permanent residence is changed to urban residents can inherit the houses and homesteads of rural parents. In judicial practice, it is generally believed that children with urban hukou cannot inherit the rural parents' homestead, but the houses built on the homestead belong to their parents' personal property and children can inherit it.

In fact, the villagers' right to use the homestead is obtained based on the villagers' specific identity. Villagers only have the right to use the homestead and cannot dispose of it at will. Homestead does not belong to citizens' personal property. Therefore, after the death of the homestead user, even if the children are rural hukou, the homestead cannot be inherited as an inheritance, and the right to use the homestead can be transferred to the children's name, unless the children themselves meet the application conditions for homestead.
