Legal analysis: notification of patent application acceptance is not equal to patent certificate. It can only show that the Intellectual Property Office has accepted the patent application. A patent certificate is a patent certificate issued to a patent applicant by the patent administrative department of the State Council (i.e. China National Intellectual Property Administration) if the patent application has passed the examination and no reason for rejection has been found, and it meets the conditions for granting a patent right. This is a legal document. Patent certificate is divided into invention patent certificate, utility model patent certificate and design patent certificate. A patent certificate is a document issued by the patent office to prove the patent right. After the patent application is examined and approved, the Patent Office shall make a decision to grant the patent right and issue a patent certificate. A patent certificate mainly records the name and patent number of the invention-creation, the names of the inventor and designer, the name and title of the patentee, the scope of rights protection, and the time when the patent was granted.

Article 39 If the application for a patent for invention is not found to be rejected after substantive examination, the administrative department for patent in the State Council shall make a decision to grant a patent right for invention, issue a patent certificate for invention, and register and announce it at the same time. The invention patent right shall take effect as of the date of announcement.
Article 40 If the application for a patent for utility model or design is not found to be rejected after preliminary examination, the administrative department for patent in the State Council shall make a decision to grant the patent right for utility model or design, issue the corresponding patent certificate, and register and announce it at the same time. The patent right for utility model and the patent right for design shall take effect as of the date of announcement.
