The difference between business method patent and ordinary method patent

The characteristics of business method patents are different from ordinary patents:

The particularity of (1) application field. As a patent closely related to Internet and computer, business method patent has its own characteristics in its application field. Today, with the continuous development of the Internet, the online transaction volume has greatly increased, and the application for business method patents is limited to the Internet, covering the entire virtual space. The geographical expansion of business method patents makes the interest groups involved more extensive and complex. A country should not only consider its own interest groups, but also the interest groups of other countries. More importantly, it involves international market competition and national industrial security.

(2) expand exclusivity. Generally, a business method patent can consider its main part from three aspects. Namely: concept, software program and control system. The subject of business method patent is the decisive factor to determine the scope of its rights, and the business method patent of the subject at the conceptual level is the most exclusive. Even if other commercial activities adopt different software programs and control systems, as long as they use the same or similar ideas as business method patents, they can be judged to be infringing.

(3) Short market life. Compared with other common patented products, the market life of business method patented products is essentially short. The reason lies in the rapid development of network and computer technology, which makes the development of business methods in software programs and control systems very rapid, and the updating speed is much faster than that of ordinary patents.
