1. The organizational forms of foreign-related patent agencies are partnerships, limited liability companies, etc.
2. Partners and shareholders of foreign-related patent agencies shall be citizens of China;
3. A foreign-related patent agency shall apply for a practice license according to law.

Article 9 of the Measures for the Administration of Patent Agents
The organizational form of a patent agency should be a partnership, a limited liability company, etc. Partners and shareholders shall be citizens of China.
Article 10
A patent agency in the form of partnership shall meet the following conditions when applying for a practice license:
(1) Having the name of a patent agency that complies with laws, administrative regulations and the provisions of Article 14 of these Measures;
(2) Having a written partnership agreement;
(3) Having an independent business place;
(4) Having two or more partners;
(5) The partner has a patent agent qualification certificate and has more than two years' experience as a patent agent.
