Domestic trademark registration process
1. Trademark registration is generally divided into two steps:
1. Search
Search before application Purpose: To check whether there are prior applications that conflict with the trademark to be registered, so as to reduce the risk of the application being rejected.
2. Registration
According to the provisions of Article 51 of the "Trademark Law of the People's Republic of China": the exclusive right to register a trademark shall be based on the approval of the registered trademark and the approval The product used shall prevail.
2. The following information must be prepared for trademark registration:
1. If a company applies for registration, it must provide a copy of the company's business license and an electronic version of the trademark pattern in JPG format;
2. Individual industrial and commercial households can apply for trademark registration in the name of the applicant using the trade name registered in their "Individual Industrial and Commercial Household Business License", or they can also apply for trademark registration in the name of the person in charge registered on the license. When applying in the name of the person in charge, copies of the following materials should be submitted: (1) ID card of the person in charge; (2) Business license;
3. Foreigners can apply directly with their ID card and need to provide A copy of the ID card, and an electronic version of the trademark pattern in JPG format;
3. Determine the trademark category and product/project name
The registration and search of trademarks are carried out according to international classifications. ***There are 45 international classifications, of which categories 1-34 are goods and 35-45 are services. The registration category can be determined based on the scope of use of your trademark. After determining an international classification, you can choose ten specific product names or service items for each application. For more than 10 types, an additional official fee of 100 yuan will be charged for each additional one.
IV. Entrustment procedures and time:
After signing the "Entrustment Agency Contract" with us and paying the fee, we can submit the application within 3 working days. It takes about 1 month to receive the trademark acceptance notice from the Trademark Office (after receiving the acceptance notice, you can put the word TM in the upper right corner of the trademark name for use). It takes about 1 year from acceptance to the announcement of qualified examination, and 3 months after the announcement. If there is no objection, the certificate will be authorized and issued. Once approved and registered, a trademark can be protected for ten years and can be renewed every ten years.
