1. The invention patent right shall take effect from the date of announcement.
2. According to legal provisions, parties applying for patent authorization shall submit an application to the patent administration department of the State Council. If the patent administration department of the State Council confirms that it meets the requirements after review, it will issue an invention patent certificate and register and announce it at the same time. The invention patent right shall take effect from the date of announcement.

⑴Article 26. To apply for an invention or utility model patent, a request, description and abstract, claims and other documents must be submitted.
⑵Article 34. After the patent administration department of the State Council receives an invention patent application and, after preliminary examination, determines that it complies with the provisions of this Law, it shall publish it eighteen months from the date of application. The patent administration department of the State Council may publish the application as soon as possible upon the applicant's request.
