Decisions on cancellation and decentralized administrative approval matters
In accordance with the "Administrative Licensing Law of the People's Republic of China" , "Notice of the General Office of the State Council forwarding the opinions of the Ministry of Supervision and other departments on further advancing the reform of the administrative examination and approval system" (Guobanfa [2008] No. 115) and the provincial government's requirements on further promoting the reform of the administrative examination and approval system, the provincial administrative examination and approval system reform work The Joint Conference Office organized and carried out a new round of provincial-level administrative review and approval matters sorting out work. After strict review and argumentation, the provincial government decided to retain 601 administrative licensing items and 84 non-administrative licensing approval items; cancel 53 administrative approval items and decentralize 47 administrative approval items.
All regions and relevant departments must conscientiously implement and connect the canceled and decentralized administrative approval projects, and effectively strengthen follow-up supervision. It is necessary to prevent disguised approval in the name of filing, approval, etc. It is necessary to prevent the phenomenon of “absence” or “inadequacy” of supervisory functions after administrative approval projects are canceled or decentralized. It is necessary to thoroughly implement the Scientific Outlook on Development and continue to deepen the reform of the administrative approval system in accordance with the requirements of improving the socialist market economic system, promoting the reform of the administrative management system, and transforming government functions. In accordance with the provisions of the Administrative Licensing Law, the names of reserved administrative licensing matters and non-administrative licensing approval matters, establishment basis, application conditions, approval procedures, approval period, fee standards, as well as the catalog and sample texts of application materials that need to be submitted, etc. Publicize it in the office and online, and establish supporting systems as required to provide good service.
Administrative licensing items and non-administrative licensing approval items that will be added, canceled or adjusted in the future must strictly abide by the "Administrative Licensing Law" and the relevant provisions of the administrative approval system reform, and be reported to the Provincial Government's Legal Affairs Office for review and approval. Dynamically manage administrative approval matters in accordance with the law and disclose them to the public.
If the administrative approval matters announced in the past are inconsistent with the administrative licensing matters and non-administrative licensing matters announced in this decision, this decision shall prevail.
This decision shall come into effect from the date of promulgation.
