China people have violated Japanese criminal law in Japan, and Japan will try them according to the principle of territorial management. If you are sentenced to five years in prison, you will serve five years in Japan. Whether to drive back to China depends on Japan's judgment. If a criminal is transferred to China before the execution of the death penalty, China may need to execute the remaining sentence. If the execution is completed or suspended, China will not pursue it.
Article 7 of the Criminal Law stipulates that this law shall apply to China citizens who commit crimes stipulated in this law outside the territory of People's Republic of China (PRC). However, if the maximum penalty prescribed in this law is fixed-term imprisonment of not more than three years, it may not be investigated.
