1. Those who meet the following conditions can register for the national judicial examination:
(1) They have China nationality;
(2) Support the Constitution of People's Republic of China (PRC) and enjoy the right to vote and stand for election;
(3) Having full capacity for civil conduct;
(4) graduated from law major or non-law major in colleges and universities, with legal professional knowledge;
(5) Good conduct.
fresh graduates of ordinary colleges and universities can sign up for the national judicial examination.
Applicants for graduation certificates (degrees) from Hongkong, Macau, Taiwan Province Province or foreign universities must be certified by the Study Abroad Service Center of the Ministry of Education. Those who meet the requirements for applying for academic qualifications (degrees) may apply for the national judicial examination.
2. Those who are unable to register for the examination under any of the following circumstances, and have gone through the registration procedures, the registration is invalid:
(1) Those who have been criminally punished for intentional crimes;
(2) being expelled from public office by a state organ or having his lawyer's practice certificate or notary's practice certificate revoked;
(3) Those who have been sentenced to two years' imprisonment are not allowed to register for the national judicial examination, or those who have been sentenced to life imprisonment are not allowed to register for the national judicial examination;
(4) providing false certification materials or defrauding registration by other means.
three. To apply for practicing as a lawyer according to Article 5 of the Lawyers Law, one should meet the following conditions:
(1) Support the Constitution of People's Republic of China (PRC);
(2) Pass the national unified judicial examination;
(3) practicing in a law firm for one year;
(4) Good conduct.
the lawyer qualification certificate obtained before the implementation of the national unified judicial examination has the same effect as the national unified judicial examination certificate when applying for practicing as a lawyer.
Article 6 To apply for practicing as a lawyer, an application shall be submitted to the judicial administrative department of the people's government at the municipal level or the municipality directly under the Central Government, and the following materials shall be submitted:
(1) A certificate of passing the national unified judicial examination;
(2) materials issued by the lawyers association that the applicant has passed the internship assessment;
(3) the identity certificate of the applicant;
(4) the certificate issued by the law firm agreeing to accept the applicant.
if you apply for practicing as a part-time lawyer, you should also submit a certificate that your unit agrees that the applicant is engaged in the occupation of a part-time lawyer.
the department that accepts the application shall conduct an examination within 2 days from the date of acceptance, and submit the examination opinions and all application materials to the judicial administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government. The judicial administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, within 1 days from the date of receiving the submitted materials, conduct an examination and make a decision on whether to approve the practice. If the practice is approved, the lawyer's practice certificate shall be issued to the applicant; If it is not allowed to practice, it shall explain the reasons in writing to the applicant.
Article 7 An applicant shall not be issued a lawyer's practice certificate under any of the following circumstances:
(1) He has no or limited capacity for civil conduct;
(2) Those who have been subjected to criminal punishment, except for negligent crimes;
(3) Being expelled from public office or having his lawyer's practice certificate revoked.
