Can the patent reexamination be submitted by the applicant himself?
Where a patent application is rejected because it does not conform to the provisions of the Patent Law and its detailed rules for implementation, if the applicant refuses to accept the rejection decision, he may file a request for reexamination with the Patent Reexamination Board within the prescribed time limit. The request for review can be made by all rejected applicants, or by re-entrusting an agency. If the applicant whose application is rejected belongs to the same applicant, if not all applicants, the Patent Reexamination Board shall notify the applicant to make corrections within a specified time limit, and if the applicant fails to make corrections within the time limit, a reexamination shall be conducted.
