According to Article 25 of the Patent Law, scientific discoveries cannot be granted patent rights.
Scientific discovery refers to revealing the objectively existing substances, phenomena, changing processes, characteristics and laws in nature. They are different from the technical scheme of transforming the objective world and do not belong to the invention in the sense of patent law.
Finding a new substance from nature is just a discovery and cannot be patented.
