How to apply for priority in PCT international patent?
The PCT international application stage is a retrieval review stage, which limits the time for claiming priority, that is, the patent applicant needs to submit the PCT international patent application within 12 months. For a patent application submitted through the PCT channel, the applicant can choose a PCT member country before the expiration of 30-3 1 month from the priority date, submit a written statement to the patent office of that country, and enter the national phase of that country after approval. When filing a PCT international patent application, if the previous application falls into one of the following three situations, priority is not required: authorization, priority and divisional application. Among them, it is most likely that the utility model patent applied in advance has been authorized at the time of PCT application because of the short examination time, so the priority is regarded as not put forward. In addition, the invention patent of the same invention-creation will destroy the novelty of the later application or conflict with the application because the utility model patent has been authorized, and the later invention application will still not be authorized. Therefore, for the same invention-creation filed in China on the same day, it is best to claim the priority of the invention and utility model patent application at the same time when submitting the PCT international patent application.
