According to the Patent Law, the Patent Agency Regulations and the rules of relevant departments, the relevant matters of the 20 17 national patent agent qualification examination are hereby announced as follows:
I. Registration
(1) Registration conditions
China citizens who support the Constitution of People's Republic of China (PRC) and meet the following conditions may sign up for the national patent agent qualification examination:
1. 1.8 years old, with full capacity for civil conduct;
2. University degree in science and engineering or equivalent;
3. Familiar with patent law and related legal knowledge;
4. Engaged in scientific and technical work or legal work for more than two years.
Graduation of science and engineering majors in colleges and universities refers to obtaining a college degree or above recognized by the state and obtaining a diploma or degree certificate.
Applicants for graduation certificates and degree certificates from Hongkong, Macau, Taiwan Province Province or foreign institutions of higher learning must be certified by the Study Abroad Service Center of the Ministry of Education. Those who meet the requirements of applying for graduation certificate and degree certificate can sign up for the exam.
Those who have studied for a master's degree in institutions of higher learning for one year and those who have studied for a doctor's degree in institutions of higher learning are deemed to have been engaged in scientific and technological work for more than two years.
(2) Setting of test sites
On 20/0/7, KLOC set up test sites in 30 cities, namely Beijing, Tianjin, Shijiazhuang, Taiyuan, Hohhot, Shenyang, Changchun, Harbin, Shanghai, Nanjing, Suzhou, Hangzhou, Hefei, Fuzhou, Nanchang, Jinan, Zhengzhou, Wuhan, Changsha and Zhengzhou.
Candidates from Hong Kong Special Administrative Region, Macao Special Administrative Region and Taiwan Province Province can choose to take the exam in Beijing, Shanghai, Guangzhou or Fuzhou.
Candidates can choose the test center to take the test according to their own situation when registering.
(3) Registration procedure
Applicants participating in the national patent agent qualification examination shall register through the "Patent Agent Qualification Examination Registration System" (hereinafter referred to as the registration system) of China National Intellectual Property Administration website. Registration is divided into three steps: forecast name, qualification examination and payment confirmation. The intellectual property office of the city (autonomous region or municipality directly under the Central Government) where the test center is located (hereinafter referred to as the intellectual property office of the test center) is responsible for registration.
1. Forecast name
Applicants should take the exam through the registration system from 0: 00 on July 3, 2065438 to 24: 00 on July 28, 2007, and no supplementary report will be made after the deadline. Applicants should fill in the registration information truthfully and accurately according to the guidance of the registration system, clearly choose the examination method, upload relevant materials, and promise to be responsible for its authenticity.
2. Qualification examination
After the prediction is successful, the intellectual property office of the test center will review the qualifications of the applicant. Applicants should actively cooperate with the audit process. When the registration information is wrong, it should be corrected in time. The qualification examination period is from July 3, 2065438 to August 4, 2007. Failing to modify or correct the registration information as required within the time limit shall be deemed as unqualified.
3. Payment confirmation
Candidates who have passed the qualification examination shall pay the examination registration fee online or on-site at the Intellectual Property Office of the selected test center according to the prompt of the registration system. The deadline for online payment is August 8, 2007 at 2065438+24: 00. The time and place of on-site payment shall be designated by the Intellectual Property Office of each test center.
Applicants can only confirm the completion of the registration procedure after paying the examination registration fee in full and on time. If the registration fee is overdue or not paid in full, it will be regarded as incomplete registration. Once the registration fee is paid, it will not be refunded. After the payment is confirmed, the applicant shall not change the test center and examination method.
Registration is regarded as submitting a pre-application for patent agent qualification.
(4) Application materials
Applicants should fill in or upload the following materials when registering:
1.20 17 National Patent Agent Qualification Examination Registration Form and Patent Agent Qualification Pre-application Form.
2. A scanned copy of my valid identity document.
Mainland applicants should upload a scanned copy of their resident identity card, military officer's card or passport when registering.
Applicants in the Hong Kong Special Administrative Region should upload a scanned copy of the permanent residence certificate or passport of the Hong Kong Special Administrative Region when registering.
Applicants of the Macao Special Administrative Region shall upload a scanned copy of the permanent resident card or passport of the Macao Special Administrative Region when registering.
Applicants in Taiwan Province Province should upload a scanned copy of mainland travel permit for taiwan residents and a scanned copy of Taiwan Province resident ID card or passport when applying for registration. If it is not possible to upload mainland travel permit for taiwan residents, it shall upload Taiwan Province resident ID card and household registration transcript or household registration book.
3. A scanned copy of my education or degree certificate. Applicants with academic degree certificates from Hongkong, Macau, Taiwan Province Province or foreign universities must upload a scanned copy of the academic degree certificate from the Study Abroad Service Center of the Ministry of Education.
4. A scanned copy of my work certificate. Graduate students are required to upload scanned copies of their work certificates.
5. An electronic version of my recent three-month bareheaded photo, with a color blue background, in line with the prescribed format. The specific requirements are as follows:
(1) The photo size is 48×33mm, the head width of the portrait is 2 1-24 mm, and the head length is 28-33mm；;
(2) Requirements for electronic parts: JPG format, file size between 30k and 45k, resolution of 300dpi, width of 390 pixels and height of 567 pixels.
This photo will be the only photo of my qualification examination, admission ticket and patent agent qualification certificate.
6. If the academic certificate, degree certificate, work certificate or reading certificate is in a foreign language, a Chinese translation shall be attached, and the Chinese translation need not be notarized.
7. Scanned letter of commitment for patent agent qualification application. Candidates should download the electronic version of the Letter of Commitment for Patent Agent Qualification Application from the registration system, and upload the scanned copy after signing or stamping by themselves.
(5) Admission ticket
Applicants should log in to the registration system to print the admission ticket during 20 17 and15. The admission ticket contains the personal information of the applicant and the examination time, subject and place.
Second, the exam.
(1) Date and place of the exam
20 17 national patent agent qualification examination is scheduled to be held simultaneously in each test center city on 10 from 4th to 5th.
(2) Examination subjects and time
The national patent agent qualification examination implements a national unified proposition, and the scope of the proposition is subject to the national patent agent qualification examination outline 20 17. The outline will be published on the website of China National Intellectual Property Administration Municipal Government on May 6, 2007.
The exam is divided into three subjects. The subject name and examination schedule are as follows:
Patent legal knowledge:165438+19: 00 on October 4th—11:30;
Relevant legal knowledge:1October 4th114: 00—16: 00;
Patent agency practice:165438+19: 00 on October 5th-13: 00.
(3) Examination questions and examination methods
In 20 17, the national patent agent qualification examination was a closed-book examination, with multiple-choice questions for patent legal knowledge and related legal knowledge, and discussion and practical writing for patent agents' practical subjects.
20 17 National Patent Agent Qualification Examination adopts computerized examination or paper-and-pencil answer, and the examination room for paper-and-pencil answer is uniformly set in Beijing test center.
Computerized examination method refers to the way that candidates obtain the examination questions of patent legal knowledge, relevant legal knowledge and patent agency practice subjects at the computer terminal, answer all subjects at the computer terminal and submit the answer results.
Paper-and-pencil answer mode refers to the way that candidates obtain the test questions of patent legal knowledge, relevant legal knowledge and patent agency practice subjects at the computer terminal, answer the patent legal knowledge and relevant legal knowledge subjects at the computer terminal and submit the answer results, and answer the patent agency practice subjects with paper and pencil and submit the answer sheet.
Exam questions are simplified characters, and candidates from Hongkong, Macau and Taiwan Province Province can answer in traditional Chinese characters, and professional terms stipulated by national laws, regulations and rules should be used when answering questions.
(4) Examination questions are published
After the national patent agent qualification examination, China National Intellectual Property Administration will publish the test questions and reference answers of the patent legal knowledge examination and related legal knowledge examination, publicly solicit public opinions within the prescribed time limit, and conduct research and demonstration on the feedback.
(5) Publication and examination of examination results.
The national patent agent qualification examination will be marked uniformly throughout the country, and the examination results will be announced after the marking. Candidates can check their grades through the registration system.
Candidates who think that their test scores are obviously abnormal can apply for a second interview within the prescribed time limit after the test results are announced. Examination results review is limited to re-examining whether the sum of the scores of each question on the answer sheet is wrong. Candidates are not allowed to refer to their answer sheets. The results of the results review shall be notified to the candidates who apply for the results review by the evaluation committee office through the registration system.
Three. Grant the qualification of patent agent
(a) according to the actual needs to determine the qualified score.
After the examination, the Patent Agent Examination Committee shall, according to the actual needs of the patent work in that year and the difficulty of the examination questions, determine the qualified score line after full discussion and publish it.
(2) Application for patent agent qualification
From the date of publication of the qualified score line, the pre-application for patent agent qualification of all examination subjects within the specified time will automatically turn into a formal application and take effect. After checking the registration materials of the above-mentioned personnel, China National Intellectual Property Administration granted them the patent agent qualification and issued the patent agent qualification certificate.

Fourth, exam review and training
(A) the exam guide
Applicants can review and prepare for the exam according to the 20 17 National Patent Agent Qualification Examination Guide compiled by the Office of the Patent Agent Examination Committee.
(2) Pre-test training
20 17 Pre-exam training for national patent agents will continue to play the role of China Intellectual Property Training Center, local intellectual property offices, All-China Patent Agents Association and other institutions. Training time, training content, lecturers and charging standards shall be determined by the training organizers themselves.
China National Intellectual Property Administration does not hold pre-test training courses, and the training organizers may not organize or hold training courses or conduct related publicity in the name of China National Intellectual Property Administration.
