What information do I need to provide when applying for a design patent?

Applying for a patent for design is the same as applying for a patent for invention and a patent for utility model, but in addition to submitting a request for a patent for design, the following matters should also be noted:

(1) Submit the designed pictures or photos, and the submitted pictures or photos shall be not less than 3cm× 8cm and not more than 15cm× 22cm. At the same time, an application for a patent for design containing color shall submit color pictures or photographs in duplicate.

(2) Unlike an invention or utility model, it is not necessary to submit instructions, claims, etc. When applying for a patent for design. However, "when applying for a patent for design, a brief description of the design shall be stated when necessary". The brief description should explain the design points of the design product, including the color requirements and the omission of the view. The brief description shall not use commercial advertising language, nor shall it be used to explain the performance of the product.

The product name shall meet the following requirements.

(3) The following names should be avoided:

(i) Contains names of people, places, companies, trademarks, codes, models or products named after historical time, such as the product name should not be "Cody brand monitor";

(2) General and abstract names, such as "stationery", "cooker", "musical instrument" and "building supplies".

(3) Names with structure, function or effect, such as "fuel-saving engine" and "human body heightening insole";

(4) Names with product specifications and quantity units, such as "2 1 inch color TV", "a pair of gloves" and "a pair of chopsticks". For example, the product name of the monitor should not be written as "2 1 inch monitor";

(5) Names named after the shape or color of the product, such as "red coat" and "prismatic ruler". The product name of the monitor should not be written as "red monitor";

(6) Omitting the names of writing methods, such as "chessboard" cannot be written as "chess" and "toy car" cannot be written as "car";

(vii) Foreign language names;

(8) Names with design contents, such as writing "schoolbag" as "schoolbag with panda pattern" or writing names with animal or plant patterns. For example, the product name of the monitor should not be written as "red button ultra-thin monitor".

(4) The product category shall be stated.

The applicant shall indicate the product category in column 14 of the request for a patent for design, that is, the product category in the international classification table of design. If the applicant is not clear about the product category, he can indicate the technical field or the place of use. So that the classifier can determine the accurate classification number of products and protect the patent right of design.
