1. Technical information: refers to the non-patented technology that meets the definition of trade secret. For example: technical design, applied experiments, process flow, industrial formula, chemical formula, manufacturing process, technical samples, quality control, manufacturing methods and computer programs. Technical information can be specific and complete technical contents that constitute products, processes, materials and their improvement technical schemes, and can also be a part of technologies such as products, processes, materials or technical elements of products.
2. Business information refers to methods, experiences and strategies related to business management that conform to the definition of business secrets. For example: development planning, competition scheme, management know-how, customer list, supply information, production and marketing strategy, financial situation, investment and financing scheme, pre-tender estimate, negotiation scheme, property guarantee, litigation disputes, etc.
Legal basis: Article 219 of the Criminal Law of People's Republic of China (PRC) commits one of the following acts of infringing on trade secrets, causing heavy losses to the holder of trade secrets, and shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, fixed-term imprisonment of not less than three years but not more than seven years, and fined.
(1) Obtaining the business secrets of the obligee by theft, inducement, coercion or other improper means; (2) disclosing, using or allowing others to use the business secrets of the obligee obtained by the above means; (3) disclosing, using or allowing others to use the business secrets in their possession in violation of the agreement or the requirements of the obligee to keep the business secrets.
