Design patent application

1. Those who apply for a design patent shall submit a brief description of the design. 2. The scope of protection of the design patent shall be based on the design of the product shown in pictures or photos. Brief description of the design shall be submitted. The description can be used to explain the design of the product represented by the picture or photo. 3. The brief description shall include the following contents: 1. The name of the design product. The product name in the brief description shall be consistent with the product name in the request. 2. The purpose of the design product. The brief description should state the purpose that helps determine the product category. For products with multiple uses, the brief description should state the multiple uses of the product. 3. Design of the design Key points. The design key points refer to the shape, pattern and combination of the product that are different from the existing design, or the combination of color and shape, pattern, or location. The description of the design key points should be concise and to the point. 4. Designate a picture that best Pictures or photos showing the key points of the design. The designated pictures or photos are used for publication in the patent gazette. In addition, the following situations should be stated in the brief description: 1. The situation of requesting color protection or omitting views. If the design patent application requests color protection , should be stated in the brief description. If a view is omitted in a design patent application, the applicant should usually state the specific reason for omitting the view, such as omitting it because of symmetry or similarity; if it is difficult to state, you can also just state that a certain view is omitted. For example, if a large equipment lacks a bottom view, it can be written as "omitting bottom view". 2. If a design patent application is filed for multiple similar designs of the same product, one of them should be designated as the basic design in the brief description . 3. For flat products such as floral fabrics and wallpapers, the situation where the unit pattern in the flat product is continuous on two sides or continuous on four sides without definite boundaries should be described when necessary. 4. For slender items, the name of the slender items should be stated when necessary. The length is omitted. 5. If the design of the product is made of transparent materials or new materials with special visual effects, it should be stated in the brief description if necessary. 6. If the design product is a complete set of products, it should be stated if necessary. Indicate the product name corresponding to each kit. The brief description must not use commercial promotional terms, nor can it be used to explain the performance and internal structure of the product.
