Development and reform, science and technology, industry and information technology, finance, education, commerce, state-owned assets management, taxation, industrial and commercial administration, quality and technical supervision, public security and other relevant departments shall, according to their respective responsibilities, do a good job in the promotion and protection of related patents. Fifth newspapers, radio, television, Internet and other related media should strengthen the publicity of patent knowledge and raise the patent awareness of the whole society. Sixth, strengthen the popularization education of intellectual property rights for young people; Support qualified institutions of higher learning and training institutions to set up intellectual property majors, encourage institutions of higher learning to set up intellectual property courses, and cultivate intellectual property compound talents. Chapter II Patent Creation Article 7 encourages enterprises, scientific research institutions and institutions of higher learning to formulate patent strategies and support patent creation and industrialization projects that meet the needs of economic and social development; Encourage individuals to make inventions and apply for patents. Article 8 The people's governments at or above the county level shall set up special funds for patents for the following matters:
(1) subsidizing patent applications;
(2) Promoting the implementation of patents;
(3) Construction of a patent public service platform;
(four) patent protection, early warning and emergency assistance mechanism construction;
(5) Training, exchange and cooperation of patent talents;
(6) Awards for patentees who have made outstanding contributions;
(seven) other matters to promote the development of the patent industry.
Special funds for patents shall be earmarked for special purposes. The specific measures for use shall be formulated by the financial department of the people's government at or above the county level in conjunction with the department in charge of patent work. Article 9 The provincial people's government shall set up patent awards to reward patentees who have made inventions, obtained patents and made outstanding contributions to the economic and social development of this province.
The people's governments at the city and county level divided into districts shall, in accordance with the relevant provisions of the state and this province, reward the units and individuals that have made remarkable achievements in the invention, creation and promotion of patent industrialization in this region. Article 10 People's governments at or above the county level and their relevant departments shall incorporate patent indicators into the statistical scope of national economic and social development, into the evaluation system for the implementation of science and technology plans, the performance appraisal system for state-owned enterprises, and the scientific research performance appraisal system for institutions such as universities and scientific research institutions.
Development and reform, science and technology, industry and information technology and other relevant departments should take the quantity and quality of patent rights as an important index for the identification and assessment of science and technology parks, enterprise technology centers, engineering (technology) research centers, high-tech enterprises and innovative enterprises. Eleventh provincial science and technology departments shall, in conjunction with relevant departments, according to the characteristics of industries and fields, compile and regularly publish the catalogue of key technologies and important products that should master independent intellectual property rights. The research and development, patent application and product development of key technologies listed in the catalogue shall be supported in accordance with the relevant provisions of the provincial people's government. Article 12 Enterprises are encouraged to increase investment in patent R&D, and their patent R&D expenses are included in the cost according to the relevant provisions of the state, and they are entitled to corresponding preferential tax policies. Thirteenth science and technology projects supported by government financial funds may produce patents, science and technology and other relevant departments should give priority to support, and reach an agreement with the project undertaker on the patent objectives, and incorporate patent acquisition into the acceptance of science and technology projects. The expenses incurred in applying for a patent can be included in the project funds. Article 14 Where the patent right is transferred by the entity that has been granted the patent right, the inventor or designer shall have the priority to transfer the patent right under the same conditions.
The entity that has been granted the patent right shall give the inventor or designer of the service invention-creation a bonus or remuneration. If the unit has an agreement with it, the agreement shall prevail; If there is no agreement, the after-tax profit, after-tax patent license fee and after-tax patent transfer fee of patent exploitation shall be implemented in proportion higher than the reward and remuneration stipulated by the state.
Bonuses and remuneration can be paid in cash, shares, equity income or other forms agreed by both parties. Fifteenth in the evaluation of professional and technical posts, the patents obtained by patent inventors and designers should be used as one of the basis for the evaluation of similar professional and technical posts.
Patents that have won China Patent Gold Award, Excellence Award and Provincial People's Government Patent Award can play a significant role in technological progress or achieve significant economic benefits, which can be used as the basis for inventors and designers to declare similar series of professional and technical positions. Chapter III Patent Application Article 16 Encourage and support lending institutions and guarantee institutions to carry out patent pledge business, and give priority to credit support to patent technology implementation projects with great development potential and good market prospects. If the pledged project meets the conditions for the establishment of the science and technology plan, certain risk subsidies shall be given to the borrowing (lending) institutions and guarantee institutions in accordance with the relevant provisions of the provincial people's government.
