Regulations of Jilin Province on Promoting the Development of Sci-tech Enterprises

Chapter I General Provisions Article 1 In order to promote the development of scientific and technological enterprises in our province, these Regulations are formulated in accordance with the relevant laws and regulations of the state and the actual situation of this province. Article 2 The term "scientific and technological enterprises" as mentioned in these Regulations refers to enterprises mainly engaged in the industrialization of scientific and technological achievements, technology development, technology transfer, technology consultation and technical services. Article 3 People's governments at all levels and their relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in supporting and providing services to scientific and technological enterprises, and promote the rapid and healthy development of scientific and technological enterprises. Chapter II Identification and Management Article 4 An enterprise that meets the following conditions shall apply to the administrative department of science and technology of the people's government at or above the local city (state) for identification as a scientific and technological enterprise:

(1) Enterprises registered within the jurisdiction of Jilin Province;

(2) focusing on technological innovation, focusing on new product research and development, production and technology transfer, technical consultation and technical services;

(3) The proportion of personnel with college education or above in the total number of employees shall not be less than 30%, and the proportion of scientific and technical personnel directly engaged in research and development shall not be less than10%;

(4) The asset-liability ratio shall not exceed 70%, the technology income shall account for more than 20% of the total annual income, and the annual expenditure on research and development of new technologies and new products shall not be less than 3% of the sales (the newly established technology enterprises with dissatisfaction 1 year are not subject to this restriction). Article 5 The administrative department of science and technology of the people's government at or above the city (state) level shall complete the application within fifteen working days from the date of receiving the application materials. For those who meet the conditions, confirm them; Those who do not meet the requirements will not be confirmed, and the results and reasons will be notified to the applicant in writing. Article 6 If a recognized technology enterprise changes its business scope, establishment conditions, merger, division, relocation or closure, it shall timely file with the original administrative department of science and technology that has gone through the identification procedures or cancel it. Chapter III Encouraging and Supporting Article 7 Encouraging technological development-oriented scientific research institutions and qualified enterprises to develop into scientific and technological enterprises. Eighth to encourage all kinds of organizations and individuals to use patents, proprietary technology and other scientific and technological achievements to lead and establish scientific and technological enterprises, and enjoy the relevant national and provincial support policies. Ninth to encourage scientific and technological enterprises to apply for all kinds of scientific and technological planning projects and commercialization and industrialization projects of high-tech achievements, government departments should give key support. Tenth science and technology enterprises are encouraged to implement the intellectual property strategy, and the relevant departments of the people's government where the enterprises are located will give financial support on the basis of the first production of patented invention products in the province. Eleventh financial departments and financial institutions should actively support the development of science and technology enterprises, giving priority to loan interest subsidies and credit support. Twelfth technology enterprises enjoy the following preferential policies:

(1) From the date of confirmation, the income from technology development, technology transfer, technical consultation and technical services related to it shall be exempted from business tax;

(two) the newly established independent accounting science and technology enterprises mainly engaged in technical consultation and technical services shall be exempted from enterprise income tax within two years from the date of confirmation;

(3) The expenses incurred in the research and development of new products, new technologies and new processes by scientific and technological enterprises shall be included in the management expenses. If the technology development expenses incurred by profitable industrial science and technology enterprises in the current year increase by more than 10% compared with the actual amount of the previous year, the taxable income of the current year can be deducted by 50% of the actual amount;

(four) the cost of training employees in science and technology enterprises can be included in the management expenses;

(five) scientific and technological enterprises and universities and scientific research institutions jointly set up pilot bases, industrial test bases, engineering technology centers, open laboratories and other scientific research and development institutions, and enjoy the relevant preferential policies of the state and the province;

(six) science and technology enterprises are recognized as high-tech enterprises, and enjoy the preferential treatment of high-tech enterprises according to the policy. Thirteenth people's governments at all levels shall commend and reward scientific and technological enterprises and relevant personnel who have made outstanding contributions. Fourteenth people's governments at all levels can formulate relevant policies to support the development of science and technology enterprises according to local actual conditions. Chapter IV Protection and Service Article 15 No unit or individual may engage in the following activities that infringe upon the rights and interests of scientific and technological enterprises:

(a) plagiarism, tampering, counterfeiting or other ways to infringe upon the intellectual property rights of scientific and technological enterprises and the ownership of other scientific and technological achievements;

(2) Infringe on the technical and economic rights and interests of scientific and technological enterprises or divulge business secrets;

(three) embezzlement, misappropriation of technology enterprise property and various special funds;

(four) in violation of the provisions of laws and regulations, requiring science and technology enterprises to provide manpower, material resources and financial resources;

(5) Infringement of other lawful rights and interests of science and technology enterprises. Article 16 The relevant administrative departments of the people's governments at all levels shall reduce links, simplify procedures, improve efficiency and provide convenience when handling relevant procedures for technology enterprises. Seventeenth administrative departments and their staff in violation of the relevant provisions, discrimination against science and technology enterprises, deliberately delayed, science and technology enterprises can complain to the relevant government departments. Eighteenth people's governments at all levels and their administrative departments of science and technology shall provide services for scientific and technological enterprises in scientific and technological information, scientific and technological documents, popularization and utilization of scientific and technological achievements, and scientific and technological markets. Chapter V Legal Liability Article 19 Where a technology-based enterprise is identified by fraud, its identification shall be cancelled by the original identification authority, and the relevant departments shall recover the benefits obtained from its preferential policies; If losses are caused to others, compensation shall be made according to law.
