Patent transfer process and cost

Patent transfer requires the following processes and procedures: 1. Submit the patent transfer contract signed by the legal representatives of both parties, the identity certificates of the patentee and assignee, copies of the patent certificate and legal status certificate, the termination letter of the original agency, the new power of attorney of the assignee and the original certificate of industrial and commercial change; 2. Pay the filing change fee to China National Intellectual Property Administration; 3. The China National Intellectual Property Administration Patent Office shall complete the examination and publish the registration within 3 to 5 months; 4. The transfer of the patent right shall take effect as of the date of registration and announcement in China National Intellectual Property Administration. According to Article 10 of the Patent Law, the right to apply for a patent and the patent right can be transferred. 6, China units or individuals to foreigners, foreign enterprises or other foreign organizations to transfer the right to apply for a patent or patent right, shall go through the formalities in accordance with the provisions of relevant laws and administrative regulations. 7. Where the patent application right or patent right is transferred, the parties concerned shall conclude a written contract and register it with the patent administration department of the State Council, and the patent administration department of the State Council shall make an announcement. The transfer of the right to apply for a patent or the patent right shall take effect from the date of registration.
