Article 75 Whoever produces or sells inferior drugs shall have the illegally produced and sold drugs and illegal income confiscated, and A fine of not less than one time but not more than three times the value of drugs illegally produced or sold shall be imposed; if the circumstances are serious, the company shall be ordered to suspend production and business for rectification or revoke the drug approval documents, revoke the "Drug Production License", "Drug Business License" or " Preparation License for Medical Institutions"; if it constitutes a crime, criminal responsibility will be pursued in accordance with the law.
Article 142 of the Criminal Law: Producing and Selling Substandard Drugs Whoever produces or sells substandard drugs and causes serious harm to human health shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years, and shall also be fined for selling substandard drugs. If the consequences are particularly serious, the person shall be sentenced to fixed-term imprisonment of not less than ten years or life imprisonment, and shall also be fined not less than 50% but not more than twice the amount of the sales, or have property confiscated. Selling expired drugs will face administrative penalties. In serious cases, it constitutes a crime and will be subject to corresponding criminal penalties.
The term "inferior drugs" as mentioned in this article refers to drugs that are inferior drugs in accordance with the provisions of the "Drug Administration Law of the People's Republic of China".
