The Implementing Rules of the Patent Law specifically stipulate the rewards and remuneration for inventors or designers of service-based inventions as follows:
(1) Awarded The state-owned enterprises and institutions that own the patent rights shall pay bonuses to the inventors or designers within three months from the date of announcement of the patent rights. The minimum bonus for an invention patent is not less than 2,000 yuan; the minimum bonus for a utility model patent or design patent is not less than 500 yuan.
(2) After the state-owned enterprises and institutions that have been granted patent rights implement an invention and creation within the validity period of the patent right, they shall withdraw no less than a minimum amount of profits from the implementation of the invention or utility model patent after tax every year. 2% or no less than 0.2% of the profits from the implementation of the design patent after tax shall be withdrawn as remuneration to the inventor or designer; or a one-time remuneration shall be issued to the inventor or designer with reference to the above proportion.
(3) If a state-owned enterprise or institution that has been granted a patent licenses other units or individuals to exploit its patent, it shall withdraw no less than 10% of the royalties collected for licensing the patent as remuneration after tax. Pay the inventor or designer.
(4) The above regulations on bonuses and remuneration can be implemented by other units in China as a reference.
