Does Huawei have the ability to block the United States with patents?

I am very responsible to say that there is still a long way to go. I will simply say the following aspects:

1, let's see which patents Huawei has applied for at home and abroad:

This is a rough look. Huawei has about 6,543,804 patents and 60,000 international patents.

Let's see which companies applied for these patents, all of which were applied by Huawei Group, its subsidiaries and overseas companies:

Let's see how many American patents have been applied:

In the United States, a * * * applied for 14000 patents. We should know that patent protection is regional, because the patent laws of different countries are different, but publicity is not regional. Huawei's few patents in the United States should also know that it is almost unrealistic to block others.

2. The patent in China started slowly, and the first patent law in China was 1984. Germany, which almost copied it, started a hundred years later than the United States and has already lost the patent system. Even though Huawei has applied for so many patents, there are actually few high-quality standard essential patents, such as the 5G technology patent that is being conquered now. In fact, Huawei has not taken them down yet.

3. China's patent system can't realize strong protection immediately. Because Huawei's technology is rapidly rising, if China can quickly realize strong protection, a large number of high-quality patents from the United States, Germany, Britain and other western developed countries will invade, and China's economic system will be a disaster. Speaking of this, Huawei's patents obviously have a long way to go.

4. China lacks top patent agents, patent engineers and patent lawyers in the world. Even if Huawei's patents pose a threat to the United States, they can be invalidated, licensed or even packaged to form a patent pool. But as long as we compare the patent claims, the most important legal document in the patent application documents, we will understand that there is a huge gap between the level of patent agents in China and that in the United States. This gap comes from income. For example, we entrust an American patent agent to write a statement for $300 an hour. It takes several hours for an American lawyer to write a statement. Our agent writes an application document and responds to the review comments. The invention patent took about 2 years, and the total income was about 200 dollars. Huawei's agency may be higher, but it still can't produce the world's top good patents.

You don't dare to move in other people's territory. This may seem like nonsense, but it is the truth. To give a few examples, Land Rover sued Landwind X7 for appearance infringement, as shown above.

Land Rover failed. Of course, Land Rover made a mistake. However, did Porsche later attack Zotye RS9?

Did you see the expression on Porsche boss's face?

To sum up, due to the huge differences between the national conditions of the two countries, Huawei's current patent quantity and quality and Huawei's patent team will not be involved in infringement litigation in the United States at most, and the protection of intellectual property rights system is relatively perfect. To tell the truth, it is really far from being able to kill the United States!
