Filing of patent license contract refers to the act of the patent administrative department or the department entrusted by it to keep the patent license contract that has been concluded and taken effect by the parties and publicize it to the public.
according to the detailed rules for the implementation of the patent law and the Measures for the Administration of Filing Patent License Contracts issued by the 18th Director of State Intellectual Property Rights, after the signing of a patent licensing contract, the parties (licensor and licensee) shall go through the filing formalities at the department designated by China National Intellectual Property Administration within 3 months from the date when the contract comes into effect. Licensor and Licensee shall entrust a natural person with full capacity for civil conduct to handle the filing formalities.
At present, there is no clear stipulation on the fee for filing patent transfer, which generally varies from 5 yuan to 1 yuan.
