There are three types of patents in my country: invention patents, utility model patents, and design patents. Authorized invention patents and utility model patents must be novel, creative and adaptable. During the approval process, invention patents need to go through five stages: acceptance, preliminary examination, publication, practical examination, and authorization. Under normal circumstances, it takes about 18 months from acceptance to publication (advance disclosure is required after passing the preliminary examination. Publicly available, the average is about 6 months, which can save about a year). It takes about 1 and a half to 2 years to complete from actual review to authorization. Of course, there are special circumstances where it will take longer. Applicants who want to speed up the approval cycle can apply for early disclosure, which can speed up the patent authorization cycle. For utility model patents and design patents, approval only needs to go through three stages: acceptance, preliminary review, and authorization. Compared with invention patents, the authorization cycle is much shorter, generally within 6 months.
Legal basis:
"Patent Law"
Article 34: After receiving an invention patent application, the patent administration department of the State Council shall, upon preliminary examination, determine that the application is in compliance with this provision. If required by law, it will be announced immediately after eighteen months from the date of application. The patent administration department of the State Council may publish the application as early as possible upon the applicant's request.
