If the customs discovers that the import and export goods for record are suspected of infringing intellectual property rights, it shall immediately notify the intellectual property right holder in writing. If the intellectual property right holder applies in accordance with relevant laws and provides guarantee according to law within 3 working days from the date of service of the notice, the customs shall detain the suspected infringing goods, notify the intellectual property right holder in writing, and serve the customs detention certificate on the consignee or consignor.
