(1) The Pudong New Area and Huangpu District People’s Courts have jurisdiction over the following first-instance intellectual property civil cases (patent dispute cases, new plant variety dispute cases, integrated circuit layout design dispute cases, cases involving computer network domain names) Except for infringement dispute cases): 1. Non-foreign-related, non-Hong Kong, Macao and Taiwan-related cases with the subject amount of litigation below RMB 5 million; 2. Foreign-related, Hong Kong, Macao and Taiwan-related cases with the subject amount of litigation below RMB 1 million; 3. Superior people Cases over which the court has designated jurisdiction. (2) The Shanghai No. 1 and No. 2 Intermediate People's Courts have jurisdiction over the following first-instance civil intellectual property cases: 1. Cases in which the subject amount of the litigation is less than RMB 100 million; 2. Cases that have a significant impact in the jurisdiction; 3. Cases designated by the superior people's court to have jurisdiction. (3) The Shanghai Higher People's Court has jurisdiction over the following first instance intellectual property civil cases: 1. Cases in which the subject amount of the litigation is more than RMB 100 million. 2. Cases that have a major impact in this city. 3. Cases designated by the Supreme People's Court as having jurisdiction.
