Will patent application reveal technology?

Legal analysis: technology will not be leaked. After the application, generally speaking, it takes 18 months for the invention patent application to be published (the applicant may request to be published in advance). During this period, the relevant departments have the obligation of confidentiality, so the public can't know the content of the application, and the substantive examiner can't know the content. Patent substantive examination is conducted by full-time examiners, whose job is to examine. They have nothing to do with the industry and can largely avoid peer review and embezzlement.

Legal basis: Article 21 of the Patent Law of People's Republic of China (PRC). The patent administrative department of the State Council shall handle patent applications and requests in accordance with the requirements of objectivity, fairness, accuracy and timeliness. The patent administrative department of the State Council shall strengthen the construction of public service system for patent information, publish patent information completely, accurately and timely, provide basic patent data, and publish patent bulletins regularly to promote the dissemination and utilization of patent information. Before the patent application is published or announced, the staff of the patent administration department in the State Council and relevant personnel shall be responsible for keeping the contents confidential.
