Does the patent license have to be filed with the National Bureau?

Whether the patent licensing contract is filed or not does not affect the effectiveness of the contract itself. In other words, the filing of patent licensing contracts is not a mandatory requirement of the law, but a way for the state to manage patent licensing behavior.

Legal basis: Article 8 of the Measures for Filing Patent Licensing Contracts in People's Republic of China (PRC), when applying for filing a patent licensing contract, the following documents shall be submitted: (1) An application form for filing a patent licensing contract signed or sealed by the licensor or its entrusted patent agency; (2) Patent licensing contracts; (3) Identification certificates of both parties; (4) If a patent agency is entrusted, the power of attorney of the authorizing organ shall be indicated; (5) Other materials that need to be provided.
