If it is an application for a patent for invention, there will be two opportunities for active revision after the patent application is accepted. One is to submit a "request for substantive examination" at the same time (the time limit for submitting a request for substantive examination is within three years from the date of application, and the priority date is within three years). The other is to make a request within three months after receiving the "Notice of Entering the Substantive Examination Stage (issued in response to the substantive examination request made by the above-mentioned applicant)" issued by the Patent Office. Therefore, to some extent, the request for substantive examination determines the start time of substantive examination of inventions. In addition, the time of publication also determines the beginning of the invention examination stage, because the invention must be published before the substantive examination. If the applicant does not request to publish in advance, the application for a patent for invention will be published 18 months from the date of filing.
If it is an application for a patent for utility model or design, because there is only a preliminary examination (formal examination) and there is no substantive examination process, it will prolong the examination time to propose active revision. An applicant for a patent for utility model or design may, within 2 months from the date of application, put forward amendments to the application for a patent for utility model or design.
In addition, active modification shall comply with the provisions of Article 33 of the Patent Law, that is, "an applicant may modify his patent application documents, but the modification of the application documents for patents for inventions and utility models shall not exceed the scope recorded in the original specification and claims, and the modification of the application documents for patents for designs shall not exceed the scope shown in the original pictures or photographs."
