Historical research is one of the important methods of legal research. China's modern patent legal system draws more lessons from the west horizontally and less vertically. Patents in the legal sense in China appeared in the late Qing Dynasty, and experienced the periods of Beiyang Government and Nanjing National Government, and continued to develop and improve after the founding of New China. This paper discusses the origin and development of China's patent legal system, hoping to help further improve the patent legal system under the background of building an innovative country.
