First of all, the mascot "Ice Shield" is an important property of BOCOG. BOCOG enjoys the copyright, exclusive right of registered trademark and patent right of design for the image of "Ice Shield", and exclusive right of registered trademark for Chinese and English names. Therefore, anyone who uses the image or name of "Bingdundun" shall abide by the provisions of People's Republic of China (PRC) Copyright Law, People's Republic of China (PRC) Trademark Law, People's Republic of China (PRC) Patent Law and other relevant laws and regulations.
For example, the image of "Ice Shield" is a work of art, and the copyright of BOCOG is protected by law. Without BOCOG's permission, no other unit or individual may use this work except for reasonable use according to law, and shall not distort or tamper with the image of "Ice Shield".
Similarly, BOCOG's exclusive right to use registered trademarks and design patents for the image and name of "Ice Shield" are also protected by law. BOCOG has the right to investigate the legal responsibility of the infringer for illegal use.
Secondly, the image and name of "Ice Shield" enjoyed by BOCOG includes not only traditional intellectual property rights such as works, trademarks and patents, but also the exclusive rights of Olympic symbols. It is unique to China to take special protection measures for some important Olympic elements, which stems from the Regulations on the Protection of Olympic Symbols and also reflects China's respect for Olympic rules. At present, China National Intellectual Property Administration has published 63 Olympic symbols. It includes not only the lovely mascot "Ice Shield", but also the Olympic rings and the emblem of Beijing Winter Olympics.
Generally speaking, unauthorized imitation and commercial use belong to infringement. In other words, you can paint or carve it yourself, but you can't sell it.
