Legal analysis: Confidentiality review refers to the review of Chinese inventions that apply for patents abroad. Not everything needs to undergo confidentiality review. Inventions completed in China that apply for patents in foreign countries need to undergo confidentiality review.
Legal basis: Article 20 of the Patent Law of the People's Republic of China. Any unit or individual that applies for a patent in a foreign country for an invention or utility model completed in China must report it to the State Council Patent Office in advance. The executive branch conducts confidential reviews. The procedures and deadlines for confidentiality review shall be implemented in accordance with the regulations of the State Council.
Any abuse of patent rights, elimination or restriction of competition, constituting monopolistic behavior shall be dealt with in accordance with the Anti-Monopoly Law of the People's Republic of China.
