There are three types of patents in Hungary: 1. Invention patent 2. Appearance patent 3. Utility model patent

If the invention applied for does not form part of the prior art, then the invention will be considered novel. Anything available to the public before the priority date by means of written description or oral communication, by use or any other means constitutes prior art. If there is content of a patent or utility model national application with an earlier priority date or any relevant content equivalent to the national application, it shall also be considered as prior art if it is disclosed after the priority date.
2. Non-destructive disclosure
Non-destructive disclosure mainly refers to relevant disclosure of inventions that occurred no earlier than 6 months before the priority date. Mainly due to the abuse of the applicant's rights or the fact that the applicant or the original right holder has exhibited it at an officially recognized exhibition, it is not considered to be existing technology.
The relevant departments in Hungary will conduct searches and substantive examinations of patent applications, and publish relevant reports on patent applications and searches. The scope of protection of a patent is determined by the claims, and the claims should be interpreted based on the description and drawings.
3. Protection period and revocation
The Hungarian patent protection period is 20 years from the date of application.
If the relevant department finds that the subject matter of the patent cannot be patented or that the content of the specification does not meet the relevant statutory requirements, or the content of the patent exceeds the relevant content of the application submitted on the filing date, the patent will be revoked. The revocation shall have retroactive effect.
Anyone can initiate the revocation process. When the revocation request is withdrawn, the process continues. If the party concerned makes a relevant request within 30 days from the date of notification of the decision, the relevant department can conduct a judicial review of the Patent Office's decision.
