Gene discovery includes gene sequencing, gene function identification and gene location. Finding a gene requires a lot of manpower and material resources, which is a model of intellectual property protection.
But there must be someone who opposes this. Most of them don't want to spend money and time on research, but want to get something for nothing. Some governments, such as France, expressed their opposition. Of course, they will fight hard, but this does not represent the mainstream thinking of the scientific community.
