What is the nature of the trial association?

The Patent Examination Cooperation Center of China National Intellectual Property Administration Patent Office is divided into seven sub-centers: Beijing, Tianjin, Jiangsu, Henan, Guangdong, Sichuan and Hubei. It is a public institution with a contract period of 4 years (actual examination), and it is a self-supporting public institution. China National Intellectual Property Administration belongs to the civil service establishment. The Patent Examination Cooperation Center is now a subordinate unit of the Patent Office of China National Intellectual Property Administration No.2 Bureau, namely China National Intellectual Property Administration Patent Examination Cooperation Center.

Founded in May, 20001year, it is a public institution directly under the Patent Office of China National Intellectual Property Administration No.2 Bureau, with independent legal personality and independent personnel, labor and financial management rights. Entrusted by China National Intellectual Property Administration, it undertakes substantive examination of some invention patent applications, international retrieval and international preliminary examination of some PCT international applications, and provides enterprises with technical and legal consulting services related to patent application and protection.

The main functions are as follows:

3. Classify patent applications;

4. Make a search report on the utility model patent;

5. Participate in the examination and litigation of inventions, utility models and designs;

Provisional regulations on the administration of registration of public institutions

Article 3 After the establishment of a public institution is approved by the people's government at or above the county level and the relevant competent department (hereinafter referred to as the examination and approval authority), it shall be registered or put on record in accordance with the provisions of these Regulations.

A public institution shall have the status of a legal person.

Article 4 Institutions shall abide by the Constitution, laws, regulations and national policies.

Fifth people's governments at or above the county level registration authority (hereinafter referred to as the registration authority) is responsible for the registration of public institutions. The staffing administration organs of the people's governments at or above the county level shall strengthen the supervision and inspection of the registration administration organs and institutions.

Institutions implement hierarchical registration management. The specific measures for the administration of graded registration shall be formulated by the administrative organ of the State Council Municipality.

Where laws and administrative regulations provide otherwise for the supervision and management of public institutions, such provisions shall prevail.
