First of all, according to the patent law, the inventor or designer has the right to apply for a patent for non-service invention-creation. In order to protect this right of the inventor or designer, the patent law also specifically stipulates that no unit or individual may suppress the application for a patent for non-service invention-creation.

There are no restrictions on the age, sex and health status of patent applicants. Applicants can be China citizens, foreigners and foreign enterprise organizations. I will apply for a patent in accordance with the relevant provisions of the Patent Law of China.

In the following cases, the unit can also become a patent applicant:

First, the invention was completed by the staff of the unit in the execution of the task or mainly by using the material conditions of the unit. The right to apply for a patent for this invention belongs to the unit, not to the inventor or designer.

Second, as a legal transferee, the unit obtains the right to apply for a patent through transfer.

An invention is jointly completed by two or more inventors or designers, or is jointly completed or entrusted by two or more units. In general, all inventors, designers or invention-creation units shall jointly apply for a patent. However, the parties concerned can also make different provisions in the agreement, and one or more of them can apply for patents.
