Patent classification

According to China's patent law, patents include three categories: invention patents, utility model patents and design patents.

Technological innovation belongs to the innovation of methods or processes, and only invention patents can be declared.

If the structure of the equipment is innovative, you can apply for a patent. If the function of the equipment is changed due to the change of the structure, you can declare it as an invention patent or a utility model patent. But you can't declare a patent for appearance, which is the difference between appearance and other products.

However, if the change of its structure does not lead to the change of its function, but only makes it look different from other products, then only the appearance patent can be declared.

The patent classification number of an application for a patent for invention and utility model is identified by the IPC International Patent Classification Table. When the same patent may have multiple classification numbers, the first one is called the main classification number.

For example, if an application for a patent for invention or an application for a patent for utility model involves different types of technical topics, and these technical topics constitute invention information, it shall be classified several times according to the technical topics involved and given multiple classification numbers. Rank the classification number that best represents the invention information in the first place.

Classification table is a tool to classify patent documents in various countries. Its basic purpose is to become an effective retrieval tool for patent offices and other users to retrieve patent documents when determining the novelty and creativity of patent applications (including evaluating the advanced nature and practical value of technology).

In addition, the classification table also has important uses such as providing services:

(a) Using this classification table to arrange patent documents, users can easily obtain technical and legal information from it;

(b) As the basis for selective reporting to all users of patent information;

(c) As a basis for investigating the existing technical level in a certain technical field;

(d) As the basis of industrial property statistics, so as to evaluate technological development in various fields.
