After applying to the court for compulsory execution, the court may serve a notice of execution on the person subjected to execution. If the person subjected to execution fails to perform the judgment of the court within the time limit, the court may seal up, detain, freeze or dispose of the property of the person subjected to execution according to law; If there is no property available for execution, the court can also take enforcement measures such as restricting high consumption and joining the list of people who have lost their trust, so as to urge the people who have been executed to consciously perform the effective legal documents as soon as possible. If the court is unable to implement the above measures, the court may suspend the execution, and the execution may be resumed at any time if the person subjected to execution or the property of the person subjected to execution is discovered later. After the judgment of a criminal case, if the criminal suspect is unable to compensate the civil part and has the ability to refuse to pay compensation, the court will enforce it according to law; If it is unable to pay the compensation, the court may decide to repay it in installments according to law; If it is really impossible to execute, the execution can be suspended until the criminal suspect is able to execute again. This execution was accompanied by the death of the suspect. Because non-restitution and non-compensation may affect the sentencing of criminal suspects, they are usually not given a lighter punishment. If the criminal suspect is unable to pay compensation, causing serious difficulties to the victim's life, he may apply to the court for judicial assistance, and the relief fund will compensate the victim appropriately. Under special circumstances, when the suspect is sentenced to life (the maximum sentence for fraud), the suspect may not be able to get out. In this case, the court will liquidate his property for repayment according to law.
According to Article 256 of the Civil Procedure Law of People's Republic of China (PRC), in any of the following circumstances, the people's court shall make a ruling to suspend execution: (1) The applicant indicates that execution can be suspended; (2) The outsider raises legitimate objections to the object of execution; (3) A citizen who is a party dies and needs to wait for the successor to inherit the rights or assume the obligations; (4) The legal person or other organization as a party terminates, and the successor of rights and obligations has not been determined; (5) Other circumstances in which the people's court considers that execution should be suspended. When the suspended situation disappears, execution will resume.
