After the trial, how long will it take for the judgment to be delivered?

After the trial, the delivery time of the judgment is as follows:

1. If summary procedure is applied, the judgment is generally made within 2 days;

2. If the prison term may be more than three years, it may be extended to one and a half months:

(1) If the sentence is pronounced in court, it shall be served on the party concerned and the people's procuratorate that initiated the public prosecution within five days;

(2) if it is announced regularly, it shall be served on the parties and the people's procuratorate;

(2) if it is announced regularly, it shall be served on the parties concerned and the people's procuratorate that initiated the public prosecution immediately after the announcement. The judgment shall also be served on the defender and agent ad litem;

3. In civil cases tried by the basic people's courts through the ordinary procedure of first instance, the parties voluntarily choose to apply the summary procedure, and if the people's courts review and agree, they can apply the summary procedure;

iv. the people's court shall not change the ordinary procedure into a summary procedure in violation of the principle of voluntariness of the parties. This applies to simple civil cases with clear facts, clear rights and obligations and little controversy.

Legal basis: Article 22 of the Criminal Procedure Law of People's Republic of China (PRC)

If a case is tried by summary procedure, the people's court shall conclude it within 2 days after accepting it; Those who may be sentenced to fixed-term imprisonment of more than three years may be extended to one and a half months.

Article 221

If the people's court finds it inappropriate to apply summary procedure during the trial, it shall retry the trial in accordance with the provisions of Section 1 or Section 2 of this Chapter.
