Rules of the People's Court for Judicial Police Safety Inspection

Article 2 Safety inspection is the duty behavior of the judicial police of the people's court to prevent dangerous goods such as restricted, controlled, inflammable, explosive and corrosive from entering the trial site according to the needs of the trial work, and to ensure the personal safety of the participants in the trial activities and the smooth progress of the trial work.

Article 3 The safety inspection of the trial courts of the people's courts shall adhere to the principles of strictness, meticulousness and civilization, and shall be organized and implemented by the judicial police departments of the people's courts at all levels, with the assistance of relevant departments.

Judicial police must dress in accordance with the regulations, maintain high vigilance and have strict police appearance when conducting security inspections. Under normal circumstances, there should be no less than two people, and the number of people should be appropriately increased when the security workload is heavy.

Article 4 Courts at all levels shall be equipped with necessary safety inspection equipment, such as security doors, hand-held metal detectors, lockers, etc. Conditional courts can be equipped with X-ray inspection equipment.

Security doors are generally placed on the inner side of the gate that must pass through to enter the court, and special security channels are set up. Put a safety inspection notice board in front of the passage. Hand-held detector, as an auxiliary detection means, is used for manual detection when the examinee gives an alarm through the security gate. The cargo cabinet is placed on one side of the security door for temporary storage of goods.

The security inspection equipment shall be kept by the judicial police department and should be turned on before use to ensure that it is in good working condition; The hand-held detector should ensure that the battery is fully charged and in good condition.

Article 5 There are two basic posts for safety inspection, namely, guide and inspector.

The main job of the shopping guide is to check or register the customer's documents and guide them into the security gate; The inspector's main job is to carry out the personal safety inspection of the security gate and the safety inspection of personal belongings.

Article 6 When the judicial police carry out security inspection:

(1) Prosecutors, lawyers and other personnel who appear in court to perform their duties according to law shall examine and register valid certificates;

(2) The participants in the proceedings, the third party and the persons appearing in court shall, at the same time, check the personal safety and the personal belongings.

Article 7 The following persons are not allowed to enter the trial site:

(a) undocumented, forged, fraudulent use of other people's documents;

(2) Minors (except those approved by the court);

(3) Mental illness and drunkenness;

(four) deprived of political rights, execution outside prison, residential surveillance, bail pending trial;

(5) refusing to accept safety inspection or disobeying the arrangement of safety inspectors;

(six) other may hinder the court trial order.

Article 8 The following items shall not be brought into the trial site:

(a) Various restricted items without the permission of the court, such as audio, video and photographic equipment;

(2) It is forbidden for private individuals to carry guns, knives and other instruments with similar functions or controlled items such as sticks;

(three) inflammable, explosive, corrosive and other dangerous goods;

(4) Other articles that may disturb the trial order of the court.

Article 9 Inspection and registration of certificates:

(a) whether it exceeds the validity period;

(two) photos, names, age, gender and other related factors are consistent with the holder;

(three) whether the documents allowed to attend are consistent with the case and the court;

(four) to set up a special register to register the documents of the subjects.

Article 10 Personal safety inspection:

(1) The guide prompts candidates to take off their personal belongings and put them on the workbench near the security gate;

(2) The inspectors order the inspected person to go through the security gate again or conduct manual security inspection and re-inspection; When manual inspection is adopted, the personal safety inspection of female subjects shall be carried out by female judicial police;

(3) Manual inspection can be divided into two ways: hand-held detector inspection and manual inspection. The specific order of manual inspection is: from top to bottom, from inside to outside, from front to back. That is, from the front collar of the subject to the outside of the shoulder, palm, inside of the shoulder, armpit, back, back waist, crotch, legs and feet. When checking the hand-held detector, the hand-held metal detector should move smoothly and evenly; When conducting manual inspection, "touch pressure" should be the main method, and the manual force should be appropriate and even;

(four) the suspects should be asked;

(five) after the inspection, the client shall be prompted to take away his own belongings.

Eleventh carry-on items safety inspection:

(1) The court equipped with X-ray inspection equipment shall conduct safety inspection and inspection on all luggage, and manually open the luggage in question;

(2) Pay attention to the bottom, corners, outer pockets and interlayer when unpacking;

(3) When checking bags (bags) and other inspected items, handle them with care to prevent them from being damaged or dirty, and pay attention to properly placing items involving personal privacy;

(4) Inquiries should be made about the articles in question, and the controlled articles and dangerous goods should be controlled first and then inquired;

(5) After the inspection, the client shall assist in sorting out the luggage and remind the client to take away his personal belongings.

Article 12 Disposal of restricted articles, controlled articles and dangerous articles found:

(a) Restricted articles shall be registered. The owner of the registered restricted articles proves and restricts the quantity and model of the articles, and issues the registration number plate to the inspected after confirming the signature. Restricted items are temporarily stored in lockers. After the trial, I will take my certificate and number plate to retrieve the stored items after confirming that the items are complete and in good condition and signing. Stored items should be properly kept to prevent damage or loss;

(2) Confiscation of controlled articles such as guns and knives that private individuals are not allowed to carry shall be handled by the judicial police department in a unified manner;

(3) Dangerous articles such as inflammable and explosive articles, highly corrosive articles and other articles that are not allowed to be brought into the court shall be handled according to the method of restricted articles storage or confiscated according to relevant regulations, while ensuring that no danger occurs.

Thirteenth people who refuse to accept the safety inspection or do not obey the arrangement of the safety inspectors shall be prevented from entering the court. Those who do not listen to advice may take compulsory measures according to law.

Fourteenth judicial police officers who perform security inspections leave their posts without authorization, slack off, dereliction of duty, etc. If serious consequences are caused, it shall be handled in accordance with the People's Police Law of the People's Republic of China, the Measures for Investigating the Responsibility of Judicial Officers in People's Courts for Illegal Trials (Trial) and the Measures for Disciplinary Actions in People's Courts (Trial). If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 15 These Rules shall come into force as of the date of promulgation.
