Article 2 A people's court shall try the following cases of first instance by a collegial panel composed of people's jurors and judges, except for cases that are tried by summary procedure and cases that are otherwise stipulated by law:
(1) Criminal, civil and administrative cases with great social impact;
(2) A case in which the defendant in a criminal case, the plaintiff in a civil case or the defendant and plaintiff in an administrative case apply to be tried by a collegiate panel of people's jurors.
Article 3 When people's jurors and judges form a collegiate panel to hear a case, the proportion of people's jurors in the collegiate panel shall not be less than one third.
Article 4 A citizen serving as a people's juror shall meet the following conditions:
(a) support the constitution of People's Republic of China (PRC);
(2) At least 23 years old;
(3) Good conduct, fairness and decency;
(4) being in good health.
As a people's juror, you should generally have a college degree or above.
Article 5 Members of the Standing Committee of the People's Congress, staff members of people's courts, people's procuratorates, public security organs, state security organs and judicial administrative organs, practicing lawyers and other personnel shall not serve as people's jurors.
Article 6 The following persons shall not serve as people's jurors:
(1) Having received criminal punishment for committing a crime;
(2) Being expelled from public office.
Article 7 The number of people's jurors shall be determined by the basic people's court according to the needs of hearing cases and submitted to the Standing Committee of the people's congress at the same level.
Article 8 A citizen who meets the requirements for serving as a people's juror may be recommended to the basic people's court by his unit or the grassroots organization where his domicile is located, or he may apply himself. The basic people's court shall examine the people's jurors jointly with the judicial administrative organ of the people's government at the same level, and the president of the basic people's court shall propose candidates for people's jurors and report them to the Standing Committee of the people's congress at the same level for appointment.
Article 9 The term of office of a people's jury is five years.
Article 10 It is the right and obligation of people's jurors to participate in judicial activities according to law. People's jurors participate in judicial activities according to law and are protected by law.
The people's court shall ensure that people's jurors participate in judicial activities according to law.
The unit to which the people's jurors belong or the grassroots organization where the household registration is located shall ensure that the people's jurors participate in judicial activities according to law.
Article 11 People's jurors participate in the collegiate bench to hear cases and independently exercise their voting rights in ascertaining facts and applying laws.
The collegial panel shall follow the principle that the minority is subordinate to the majority when deliberating cases. If the people's jurors disagree with other members of the collegial panel, their opinions shall be recorded. When necessary, the people's jurors may request the collegial panel to submit the case to the president for decision whether to submit it to the judicial committee for discussion and decision.
Article 12 The withdrawal of people's jurors shall be implemented with reference to the legal provisions on the withdrawal of judges.
Thirteenth people's jurors to participate in judicial activities, should abide by the provisions of the judge to perform their duties, keep the trial secret, pay attention to judicial etiquette, and safeguard the judicial image.
Fourteenth cases tried by people's jurors according to law shall be randomly selected from the list of people's jurors.
If the intermediate people's court or the higher people's court should be tried by a collegiate bench according to law, it shall be randomly selected from the list of people's jurors in the basic people's court of the city where it is located.
Fifteenth basic people's courts in conjunction with the judicial administrative organs of the people's governments at the same level to train people's jurors, improve the quality of people's jurors.
Article 16 People's jurors who have made remarkable achievements or made other outstanding deeds in judicial work shall be commended and rewarded.
Article 17 If a people's juror is found by the basic people's court in conjunction with the judicial administrative organ of the people's government at the same level to be under any of the following circumstances, the president of the basic people's court shall request the Standing Committee of the people's congress at the same level to remove him from his post as a people's juror:
(1) I apply to resign as a people's juror;
(2) refusing to participate in trial activities without justifiable reasons, which affects the normal conduct of trial work;
(3) Under any of the circumstances listed in Articles 5 and 6 of this decision;
(four) in violation of the relevant provisions of the law and judicial work, favoritism, resulting in wrong judgment or other serious consequences.
If a people's juror commits one of the acts listed in Item 4 of the preceding paragraph, which constitutes a crime, he shall be investigated for criminal responsibility according to law.
Article 18 The people's court shall subsidize the transportation, food and other expenses incurred by people's jurors participating in trial activities.
People's jurors with work units shall not deduct their wages, bonuses and other welfare benefits in disguise during the trial activities.
During the trial of people's jurors with no fixed income, the people's court shall refer to the local average monetary wage level of employees in the previous year and give subsidies according to the actual working days.
Article 19 The subsidies that people's jurors should enjoy when participating in trial activities and the expenses necessary for the people's courts and judicial administrative organs to implement the jury system shall be included in the operating funds of the people's courts and judicial administrative organs and shall be guaranteed by the government finance at the same level.
