The issuance of lawyer's practice license will not examine criminal records and relatives, and the political examination of lawyer's qualification is not as harsh as that of civil servants. Therefore, as long as the applicant himself has not received criminal punishment, has not been expelled from public office, and has not had his lawyer's practice license revoked, the files of the applicant's family members will not be examined. However, those who have committed criminal offences cannot take the judicial examination.
Legal basis: Article 5 of the Rules for the Administration of Lawyer Applicants' Practice shall meet the following conditions:
(a) support the constitution of People's Republic of China (PRC);
(2) Obtaining a legal professional qualification certificate or a lawyer qualification certificate;
(3) Good conduct;
(4) Having full capacity for civil conduct;
(5) Having not received criminal punishment for intentional crime;
(6) Not being dismissed from public office or having his lawyer's practice certificate revoked.
