Chapter I General Principles
Article 1 In order to guarantee villagers' autonomy according to law, strengthen the construction of villagers' committees, ensure the normal operation of village affairs, and promote the construction of two civilizations in the village, these Articles of Association are formulated in accordance with the relevant provisions of the Organic Law of Villagers' Committees of the People's Republic of China and national laws, regulations and policies, and in combination with the actual situation of the village.
Article 2 The villagers' committee must carry out village affairs management under the leadership of the general party branch of the village and within the scope of national laws, regulations and policies, and must embody the principles of democratic decision-making, democratic management and democratic supervision, and practice self-management, self-education and self-service. Actively assist the higher government to do all the work and complete all the tasks assigned by the street office.
Article 3 In order to ensure the legal, standardized and orderly conduct of village affairs, the villagers' committee shall set up four committees, namely, health care, mediation, sanitation, family planning and social security, which shall accept the leadership of the villagers' committee and be responsible to the villagers' committee. At the same time, it is necessary to establish a system of villagers' representative meetings, a system of making village affairs public, and village rules and regulations to ensure the implementation of various provisions of villagers' autonomy.
Article 4 The Articles of Association shall be discussed and adopted by the villagers' meeting on the basis of widely listening to the opinions of the villagers in the village. It is not only the rules for village committees to implement village management, but also the code of conduct for all villagers. All cadres and the masses must abide by the Articles of Association.
Article 5 The Articles of Association shall be implemented by the villagers' committee and supervised by the villagers' representative meeting. Chapter II Management of Village Cadres
Article 6 All village cadres must be responsible to the villagers, accept the leadership of the village Party branch and the guidance of the sub-district office, obey the management of the village committee, fulfill their duties, strive to do a good job in the division of labor, firmly establish the idea of serving the villagers wholeheartedly, take the lead in fulfilling the obligations of party member and the villagers, and are not allowed to be special villagers, encroach on the interests of the villagers, and rely on their authority to seek personal gain for themselves and their relatives, covet enjoyment and violate the law and discipline.
Article 7 Establish a system of villagers' committees reporting their work to villagers' meetings or villagers' representative meetings, report their work to villagers' representative meetings once a year, organize a plenary meeting of villagers' committees once a month, convey and implement the documents of higher authorities, study and deploy the work of the village, exchange information and implement tasks.
Article 8 cadres practice the responsibility system. According to the requirements of the existing cadres and village affairs management in the village, the post division and task quota are combined to decompose all village affairs into each village cadre. The specific division plan shall be reported by the village "two committees" to the villagers' representative meeting.
Ninth, establish an assessment system for cadres' term objectives. According to the current situation of economic and social development of the village, the term goal of this village Committee is formulated, the methods and measures to realize the term goal are studied and implemented, and the annual work goal is determined.
Tenth village cadres' remuneration is determined according to the completion of the post responsibility system issued by the town government every year and reported to the town party Committee for approval. The remuneration of other cadres shall be reported to the village committee for comments according to the financial situation, post workload and work objectives, and submitted to the villagers' representative meeting for discussion and adoption. The basic salary and post subsidy are fixed for one year and settled at the end of the year.
Eleventh establish and improve the villagers' evaluation system for cadres. Organize a cadre appraisal activity once a year, combine the annual work summary, conduct democratic appraisal on every cadre at the villagers' representative meeting, and publicize and commend outstanding cadres; Incompetent cadres should be corrected within a time limit, and those who are not suitable for continuing to serve as cadres should be replaced according to the cadre production procedures. Chapter III Management of Public Welfare Undertakings
Article 12 Villagers' production service organizations shall be established, personnel with a certain cultural foundation and technical expertise who are enthusiastic about serving the villagers shall be selected, and special service groups shall be set up for the purpose of benefiting the people, promoting production and developing the economy, and providing services for villagers' various production and economic activities. The service team works under the leadership of the village "two committees".
Article 13 In order to ensure the financial input of various public affairs and public welfare undertakings in the village and set up the labor services needed for collective production of public welfare undertakings in the village, the villagers shall be raised in strict accordance with the principles of "one case, one discussion", according to their capabilities, prior budget, upper limit control, democratic decision-making and democratic management. The target of raising labor is limited to male 18-55 years old and female 18-50 years old. Each labor force shall not exceed 3 workers per year, and farmers shall voluntarily choose whether to work or work for their capital. Need to raise funds for farmers to invest in projects, the amount and other matters, under the guidance of the neighborhood offices, by the village committee (village collective economic organizations) to make plans in advance, make a budget, submitted to the villagers (members) meeting or the villagers (members) representative meeting authorized by the villagers (members) meeting for discussion and adoption, reported to the neighborhood offices for approval, and reported to the rural management institutions of the people's governments at the county level for the record.
Article 14 The expenses required by villagers' committees for public affairs and public welfare undertakings shall be raised from village economic cooperatives and villagers, and the use of funds and income and expenditure accounts shall be published item by item, and they shall be subject to the supervision of villagers and cooperatives. Chapter IV Supervision and Management of Collective Economy
Fifteenth village collective economy, including the collective assets of the village collective, belongs to the village collective, and the village economic cooperative is responsible for the management. Villagers' committees respect and support the autonomy of cooperatives to independently carry out economic activities, and have the right to supervise and manage the business activities of collective economy.
Sixteenth all land rights in the village are owned by the village collective, operated and distributed by the village cooperative, and supervised and managed by the village committee. Land contractors and legitimate users only have the right to use, but have no ownership.
Seventeenth in order to strengthen the planning and management of rural construction, it is really necessary to build, expand or rebuild any buildings and lay roads and pipelines. Suggestions and applications must be submitted to the villagers' committees, reported to the streets and higher authorities for examination and approval, and strictly obey the planning and management.
Eighteenth villagers' committees shall supervise and manage the village financial work.
Article 19 The village committee supports and urges the village cooperatives to complete the following matters: ① Annual financial plan; (2) unplanned large financial expenditure accounts; (3) Main production projects, contracting methods and contracting indicators; (4) Debt relief; (5) the sale and scrapping of large and medium-sized fixed assets; ⑥ Income distribution scheme; ⑦ How much the village cadres pay; ⑧ Other important matters. For the economic losses caused by violation of the above provisions of this article, on the basis of finding out the responsibility, the responsible person shall make compensation as appropriate. Under the guidance of the street discipline inspection commission, the village affairs supervision team has the right to supervise the village economy and finance.
Article 20 The distribution and use of all kinds of agricultural materials and agricultural inputs allocated by the higher government shall be proposed by the village "two committees" and cooperatives, and discussed and decided by the villagers' representative meeting. The distribution and use of all kinds of funds and materials shall be posted and accepted by villagers. Chapter V Family Planning Management
Article 21 The general secretary of the Party branch of the village and the director of the village committee shall take overall responsibility for the family planning work in the village, and the village committee cadres shall be responsible for the daily affairs by setting up full-time family planning administrators. All people living in the village, including villagers and temporary residents, must abide by the national family planning policy and obey the family planning management of the village. The village "two committees" have the right to report to the higher government for punishment according to relevant regulations.
Twenty-second couples who meet the provisions of the Marriage Law and the provincial family planning regulations and hold the Reproductive Health Service Certificate are allowed to have children, and women of childbearing age must implement reliable birth control measures in accordance with the informed choice agreement within four months after giving birth. Unplanned pregnancy must take remedial measures in time, and unplanned birth shall be punished according to the relevant provisions of provincial regulations.
Twenty-third women of childbearing age regularly check the pregnancy and check the disease system, grasp the pregnancy situation of women of childbearing age in the village, find unplanned pregnancy in time, conduct induced abortion in time, and prevent induced labor in big months.
Article 24 Abandoning infants and drowning infants are strictly prohibited. Offenders shall be dealt with according to relevant laws and regulations, and foreigners shall not be hidden to escape family planning. In case of violation, financial penalties will be imposed.
Article 25 Whoever makes things difficult, besieges, attacks or obstructs family planning workers shall be fined, and if serious consequences are caused, they shall be transferred to judicial organs for criminal responsibility according to law. Chapter VI Social Security Management
Twenty-sixth in order to maintain the stability of social security in the village and create a good production and living environment, the villagers' committee shall set up a people's mediation and public security committee to be responsible for the comprehensive management of social security in the village. Establish and improve the voluntary mediation team, with the factory director and the leader of the villagers' team as the voluntary mediators, assist the village people's mediation committee to mediate civil disputes in the village, prevent conflicts from intensifying, and prevent criminal cases and public security cases from happening. Twenty-seventh vigorously carry out the "Fourth Five-Year Plan" legal education, using various propaganda tools and other forms to publicize the legal system. Educate villagers to abide by laws and regulations, abide by social ethics, carry out "mass prevention and mass treatment" of social security, strengthen safety precautions, boldly report and expose all kinds of illegal and criminal acts, and fight against all illegal acts.
Twenty-eighth to assist the political and legal organs in the management of flammable, explosive, toxic, rescue and management tools and other dangerous goods. Gambling and drug abuse are strictly prohibited. Those who are found to provide drug abuse and gambling places should be criticized and educated, and those who do not listen to dissuasion should be reported to the public security organs for handling. Those who use feudal superstitions to swindle and cheat should be persuaded, educated, discouraged or reported to judicial organs for handling.
Twenty-ninth in order to strengthen the discipline and education of the reformed people, the villagers' committee shall designate a special person to supervise, educate and help the reformed people. Foreigners who live in the village shall register with the village security committee, and shall not stay with unknown persons without permission. Those who provide foreigners with places to commit crimes or shelter shall be punished according to the circumstances or submitted to judicial organs for handling.
Thirtieth the villagers' committee in the management of villagers' autonomy affairs at the same time, it should actively assist the subdistrict office to carry out the work, to ensure the implementation of national laws, regulations and policies in the village.
Thirty-first village committees and village economic cooperatives are responsible for supervising the completion of various national tasks undertaken by villagers, economic organizations and social organizations in their villages according to law. Villagers' committees and village economic cooperatives can take legal and economic measures when completing the national tasks, but they can take certain administrative measures. All villagers and village organizations must obey management and complete all tasks.
Thirty-second the management work undertaken by the villagers' committee may be issued to the villagers' groups and other relevant organizations in the form of a letter of responsibility, or a contract may be signed with the villagers to complete the task. The specific form is decided by the village "two committees" according to the situation. Chapter VII Supplementary Provisions
Thirty-third village articles of association conflict with national laws, regulations and policies, according to the provisions of the state.
Article 34 The Articles of Association shall come into force as of the date of promulgation. If there is any modification, it shall be discussed and approved by the villagers' representative meeting.
