Legal Basis
Article 93 The traffic management department of the public security organ shall conduct an inspection of the scene after a traffic accident. A traffic accident certification document shall be produced within 10 days from the date of site inspection. If inspection or appraisal is required, a traffic accident determination certificate shall be produced within 5 days from the date of confirmation of the inspection or appraisal results.
Article 39 If the traffic management department of the public security organ needs to inspect and appraise the physical and mental condition of the parties, personal injuries, vehicle body, vehicle and its driving speed, traces, items and on-site road conditions, it shall Appoint or entrust professional technical personnel and qualified appraisal institutions to conduct inspection and appraisal within five days from the date of surveying the site.
The inspection and appraisal shall be completed within twenty days; if an extension is required, it may be extended for ten days with the approval of the traffic management department of the municipal public security organ. If the inspection and appraisal cycle exceeds the prescribed time limit, it shall be reported to the traffic management department of the public security organ of the provincial people's government for approval.
Article 73: The traffic management department of the public security organ shall promptly prepare a traffic accident determination certificate based on the traffic accident site investigation, inspection, investigation and relevant inspection and appraisal opinions, as evidence for handling the traffic accident. The traffic accident determination letter shall state the basic facts, causes and responsibilities of the parties involved in the traffic accident, and shall be served to the parties concerned.
Article 62: The traffic management department of the public security organ shall conduct an on-site investigation within ten days from the date of the road traffic accident. In hit-and-run cases, a road traffic accident determination certificate will be produced within ten days after the hit-and-run vehicle and driver are seized. If inspection or appraisal is required, a road traffic accident determination certificate shall be issued within five days from the date of issuance of the inspection report and appraisal opinion.
The traffic management department of local public security organs may publish road traffic accident information on the Internet on a trial basis if conditions permit, but if it involves state secrets, commercial secrets or personal privacy, it shall be kept confidential.
1. For traffic accidents that do not require inspection or identification, the public security organ shall prepare a traffic accident certification within 10 days from the date of investigation of the site;
2. For traffic accidents that require inspection or identification In the event of an accident, the public security organ shall generally prepare a traffic accident determination certificate within 30 days from the date of investigation of the scene; it may be extended by 10 days upon approval. If it needs to be extended, it must be approved by the traffic management department of the provincial public security organ.
