The "Regulations on the Administration of Dog Breeding in Korla City" was considered and adopted at the 26th meeting of the Standing Committee of the 11th People's Congress of Xinjiang Uygur Autonomous Region on March 25th, 201/,and is hereby promulgated. Article 1 These Regulations are formulated in accordance with relevant laws and regulations, combined with the actual situation of Korla City, with a view to standardizing dog-raising behavior, strengthening dog-raising management, ensuring citizens' health and personal safety, and maintaining the city appearance, environment and social public order.

Second in Korla city dog and dog management shall abide by these regulations. The city limits are delineated by the Korla Municipal People's Government and announced to the public.

The management of military dogs, police dogs, zoos, dogs for scientific research and experiments and other special dogs shall be implemented in accordance with the relevant provisions of the state.

Article 3 Dogs shall be kept under the policy of combining strict management with limited management, and adhere to the principles of law enforcement by government departments, participation of grass-roots organizations in management, public supervision and self-discipline of dog owners.

Article 4 The Korla Municipal People's Government shall be responsible for organizing the implementation of these Regulations.

Korla Municipal People's Government shall establish a dog management organization led by the administrative department of construction of Korla City and composed of public security, animal husbandry and veterinary, industry and commerce, health, environmental protection and other functional departments, and give specific guidance, coordination, supervision and inspection on dog raising.

The construction administrative department of Korla City is responsible for dog registration and annual inspection, establishing dog management files, taking in dogs without owners and abandoned dogs, and investigating and dealing with behaviors that affect the city appearance and environmental sanitation, such as raising dogs without a license and selling dogs on the street.

The public security department of Korla City is responsible for handling incidents of dog wounding and barking disturbing people.

The competent department of animal husbandry and veterinary medicine in Korla is responsible for dog epidemic prevention, immunization and harmless treatment of infected dogs and ownerless dogs. Korla Animal Health Supervision Office is responsible for dog quarantine and its daily supervision, management and enforcement.

The industrial and commercial department of Korla City is responsible for the supervision and management of dog business activities.

The person in charge of the health administrative department of Korla City is responsible for rabies vaccination, diagnosis and treatment of rabies patients and monitoring of rabies epidemic.

Korla environmental protection administrative department is responsible for the environmental supervision of large-scale dog raising.

Fifth street offices, communities, owners' committees, property management and other units shall assist in dog management. Organize and carry out publicity and education on dog raising according to law and civilization, and do a good job in mediation of dog raising civil disputes. If mediation fails, report to relevant functional departments in time.

Community neighborhood committees and owners' committees may hold residents' meetings and owners' meetings, formulate a convention on dog management in this residential area according to law, and supervise the implementation. Residents and owners shall abide by this Convention.

Sixth dog registration and annual inspection system.

Seventh it is forbidden to keep strong dogs and large dogs. The specific banned varieties and standards are determined by the Korla Municipal People's Government and announced to the public.

Dogs are prohibited in teaching areas and dormitory areas of hospitals, schools and kindergartens.

Units or individuals that need to raise strong dogs and large dogs because of their work shall go through the relevant procedures in accordance with the provisions of these regulations.

Eighth units and individuals shall, within 30 days after raising a dog, take the dog to the animal husbandry and veterinary department of Korla City for immunization and obtain the immunization certificate; With the proof of immunity, register with the registration authority and get a dog license and dog license.

Article 9 The registration authority shall register and put on record within 5 working days, and issue the dog-raising registration certificate and dog-raising license; If it does not meet the requirements, the registration authority shall notify the applicant and explain the reasons in writing.

Tenth dog registration certificate is valid for one year, dog owners should be within 30 days before the expiration of the validity period, with a valid dog registration certificate to the registration authority for annual inspection procedures.

Eleventh dog owners in any of the following circumstances, shall go through the relevant formalities at the registration authority:

(1) Where the domicile is changed, the change registration shall be handled within 15 days from the date of change;

(2) If the dog is transferred or donated, the transferor and the transferee shall handle the change registration within 15 days from the date of the transferee;

(three) to give up the dog, the dog shall be sent to the detention center and the registration shall be cancelled within 3 days;

(4) If the dog-raising registration certificate or dog-raising license is lost, apply for a replacement within 15 days from the date of loss;

Article 12 The registration authority shall set up a dog reception center, which shall be responsible for receiving confiscated dogs, ownerless dogs and abandoned dogs.

Dogs housed in the detention center can be claimed and adopted within 5 days from the date of detention; The claimant and adopter shall bear the corresponding expenses such as storage, feeding and quarantine during the period of asylum; Unclaimed or adopted, the detention center is responsible for handling.

Thirteenth registered dogs give birth to puppies, the dog owner should receive the first immunization within 45 days after the puppy is born, and deal with it within three months. If the dog is not treated when it is mature, it will be sent to the detention center and treated as abandoned dog.

Fourteenth dog owners shall abide by the following provisions:

(1) Quarantine and immunize dogs according to regulations;

(2) Dogs are not allowed to enter supermarkets, shopping malls (shops), commercial streets, hotels, restaurants, beauty salons, financial institutions, scenic tourist areas (belts), parks, institutions, schools, kindergartens, hospitals, theaters, exhibition halls, gymnasiums, playgrounds, railway stations, crowded areas and other public places;

(3) Dogs are not allowed to take public transport;

(4) Dogs shall not be kept in residential quarters, office buildings or stairwells;

(five) to take a dog out, it should be tied to a dog, hold a dog registration certificate, and wear a dog tag, and be led by a person with full capacity for civil conduct;

(6) If you take a public elevator with your dog, you should avoid the peak hours of elevator operation;

(seven) the strong dogs and large dogs raised or bred by the unit shall be managed by special personnel, and shall be kept in captivity or in captivity, and shall not go out to walk the dogs;

(eight) the dog excretes feces outside, and the dog owner shall remove it in time;

(nine) shall not disturb the normal life of others, dog barks affect the rest of others, the dog owner shall take effective measures to stop it;

(ten) other circumstances stipulated by laws and regulations.

Fifteenth dogs cause harm to others, dog owners should immediately send the injured to medical and health institutions for treatment. Dog owners or managers shall bear the tort liability, but they can prove that the damage was caused by the intentional or gross negligence of the infringed, and may not bear or mitigate the liability.

Dog owners who fail to fulfill their duty of care, thus endangering traffic safety and causing traffic accidents, shall bear corresponding civil liabilities; Dog casualties, the responsibility shall be borne by the dog owner.

Article 16 Anyone who engages in dog breeding and sales, holding dog exhibitions, opening animal clinics or engaging in other dog business activities shall obtain the permission or relevant certificates from the animal husbandry and veterinary department of Korla City, and go through industrial and commercial registration according to law after being filed by the registration authority.

Seventeenth dog trading shall comply with the following provisions:

(1) Holding a valid dog quarantine and immunization certificate;

(two) dogs should be caged or take other protective measures;

(3) Trading in the approved legal business premises.

Eighteenth acts in violation of the provisions of this Ordinance, any unit or individual has the right to criticize, discourage or report to the relevant administrative departments, the relevant administrative departments shall promptly deal with.

Nineteenth registration authorities should establish dog management files, and focus on the management of dog owners who have been reported or punished many times.

Dog owners who violate these regulations and their dogs are confiscated by the registration authority and their dog registration certificate is revoked shall not apply for dog registration within three years.

Twentieth dog owners in any of the following circumstances, by the registration authority to give criticism and education, criticism and education refuses to correct, and impose a fine; If the circumstances are serious, the dog shall be confiscated, the dog registration certificate shall be revoked and the dog license shall be withdrawn.

(a) in violation of the provisions of article seventh, raising dogs or raising dogs, large dogs in the forbidden area, each fined 500 yuan;

(two) in violation of the provisions of article eighth, article tenth, without registration, annual inspection of dogs, each fine 200 yuan;

(three) in violation of the provisions of article eleventh, failed to change, cancel or go through the formalities of dog registration, impose a fine of 200 yuan;

(four) in violation of article fourteenth (two), (three), (four), (five), (six), (seven) and (eight) prohibit sexual behavior, and impose a fine of more than 50 yuan and less than 300 yuan.

Article 21 Anyone who violates the provisions of Item (1) of Article 8 and Article 14 of these regulations and fails to quarantine and immunize dogs according to the provisions shall be dealt with in accordance with the provisions of Articles 73 and 78 of the Law of People's Republic of China (PRC) on Animal Epidemic Prevention.

Twenty-second in violation of the provisions of article fourteenth (nine), raising dogs to interfere with the normal life of others, in accordance with the "People's Republic of China (PRC) * * * and public security management punishment law" provisions of article forty-third, article seventy-fifth.

Twenty-third in violation of the provisions of article sixteenth, illegally engaged in dog business activities, in accordance with animal husbandry and veterinary, industrial and commercial administration and other laws and regulations.

Twenty-fourth other acts in violation of the provisions of this Ordinance shall be handled by the relevant departments in accordance with laws and regulations.

Twenty-fifth refuse or hinder law enforcement officers to perform official duties according to law, shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twenty-sixth dog management department staff in dog management dereliction of duty, abuse of power, corruption, shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 27 If a party refuses to accept a specific administrative act of an administrative organ, it may apply for administrative reconsideration or bring an administrative lawsuit to a people's court according to law.

Twenty-eighth autonomous counties according to the actual situation, can refer to the implementation of this ordinance.

Article 29 These Regulations shall come into force on June 20 1 year 1 day.

I. The Law of People's Republic of China (PRC) on Animal Epidemic Prevention

Article 73 Anyone who violates the provisions of this Law and commits any of the following acts shall be ordered by the supervising agency for animal health to make corrections and given a warning; Those who refuse to make corrections shall be dealt with by the supervising agency for animal health, and the handling expenses shall be borne by the violator, and a fine of less than 1,000 yuan may be imposed:

(1) Failing to immunize the raised animals according to the compulsory immunization plan for animal diseases;

(two) the breeding animals or dairy animals have not been inspected or treated according to the regulations;

(three) the vehicles loaded with animals and animal products are not cleaned and disinfected in time before loading and after unloading.

Article 77 Whoever, in violation of the provisions of this Law, commits any of the following acts shall be ordered by the supervising agency for animal health to make corrections and be fined between 1,000 yuan and 10,000 yuan; If the circumstances are serious, a fine of not less than 10,000 yuan but not more than 100,000 yuan shall be imposed:

(a) without obtaining the certificate of animal epidemic prevention conditions, the establishment of animal farms (breeding areas) and isolation places, animal slaughtering and processing places, and harmless treatment places for animals and animal products without authorization;

(2) Introducing dairy animals, breeding animals and their semen, embryos and eggs across provinces, autonomous regions and municipalities directly under the Central Government without going through the examination and approval procedures;

(3) importing animals or animal products into areas without specified animal epidemic diseases without quarantine inspection.

Article 78 If, in violation of the provisions of this Law, animals slaughtered, marketed or transported do not have quarantine certificates, and animal products marketed or transported do not have quarantine certificates or quarantine marks, the supervising agency for animal health shall order them to make corrections and impose a fine of not less than 10% but not more than 50% of the value of similar animals and animal products that have passed quarantine inspection; Impose a fine of not less than one time but not more than three times the transportation cost on the carrier other than the owner.

Article 81 Whoever, in violation of the provisions of this Law, engages in animal diagnosis and treatment activities without obtaining an animal diagnosis and treatment license shall be ordered by the supervising agency for animal health to stop the diagnosis and treatment activities, and his illegal income shall be confiscated; If the illegal income is more than 30 thousand yuan, a fine of more than one time and less than three times the illegal income shall be imposed; If there is no illegal income or the illegal income is less than 30 thousand yuan, a fine of not less than 3000 yuan but not more than 30 thousand yuan shall be imposed.

If an animal clinic violates the provisions of this Law and causes the spread of animal epidemics, the supervising agency for animal health shall order it to make corrections and impose a fine of not less than 10,000 yuan but not more than 50,000 yuan; If the circumstances are serious, the animal diagnosis and treatment license shall be revoked by the issuing authority.

Two. People's Republic of China (PRC) Public Security Administration Punishment Law

Article 43 Whoever beats another person or intentionally hurts his body shall be detained for not less than five days but not more than ten days, and shall be fined not less than 200 yuan but not more than 500 yuan; If the circumstances are minor, they shall be detained for not more than five days or fined not more than five hundred yuan.

Under any of the following circumstances, the offender shall be detained for more than 10 and less than 15, and fined for more than 500 yuan 1000 yuan:

(a) gang beating, hurting others;

(2) Beating or injuring a disabled person, a pregnant woman, a person under the age of 14 or a person over the age of 60;

(3) Beating or injuring others for many times or beating or injuring more than one person at a time.

Seventy-fifth animals, interfere with the normal life of others, given a warning; Those who fail to correct after warning, or allow animals to intimidate others, shall be fined from 200 yuan to 500 yuan.

Whoever drives away animals to harm others shall be punished in accordance with the provisions of the first paragraph of Article 43 of this Law.
