Fight into the police station, how to bail? First of all, the word bail pending trial does not appear in China's criminal law and criminal procedure law, which is common in other countries. Similar to China's bail system, it is a bail system. Bail pending trial is a criminal compulsory measure stipulated in China's criminal procedure law. It refers to a compulsory measure that judicial organs order criminal suspects and defendants who have not been arrested or need to change compulsory measures after arrest to put forward a guarantor or pay a deposit, and issue a letter of guarantee to ensure that they can be used at any time to prevent them from evading investigation, prosecution and trial, and not to detain them or temporarily release them. Bail pending trial may be decided by the judicial organ, or a written application may be submitted by the family members of the criminal suspect. Criminal suspects and defendants who are suspected of fighting, intentional injury and other illegal crimes may apply for bail pending trial under any of the following circumstances: (1) They may be sentenced to public surveillance, criminal detention or independently apply supplementary punishment; (two) may be sentenced to more than fixed-term imprisonment, bail will not cause social danger; (3) A woman who is seriously ill, unable to take care of herself, pregnant or breast-feeding her baby is released on bail pending trial, which will not cause social danger; (four) the detention period expires, the case has not yet been settled, and it is necessary to get a bail pending trial. Legal basis: Article 234 of the Criminal Law of People's Republic of China (PRC) intentionally hurts another person's body, and he shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. Whoever commits the crime mentioned in the preceding paragraph and causes serious injuries shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; Whoever causes death or serious disability by particularly cruel means shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death. Where there are other provisions in this Law, such provisions shall prevail.
