Langfang City Dog Breeding Management Regulations
Chapter 1 General Principles
Article 1 is to regulate dog-raising behavior, protect the health and personal safety of citizens, and maintain City appearance, environment and social public order, these regulations are formulated in accordance with the "Implementation Measures of the Law of the People's Republic of China on the Prevention and Control of Infectious Diseases" and other relevant laws and regulations, and in combination with the actual situation of this city.
Article 2 Units and individuals engaged in dog breeding, exhibitions and other activities in urban built-up areas shall abide by these regulations.
Article 3 prohibits the establishment of dog farms, breeding farms and dog trading markets in urban built-up areas.
Article 4 The management of dog breeding work shall adhere to the principles of breeder self-discipline, public supervision, government department supervision, and participation of grassroots organizations.
Article 5 The municipal and district people's governments are responsible for organizing the implementation of these regulations and establishing municipal and district dog management departments composed of public security, animal husbandry and veterinary, urban management comprehensive law enforcement, industrial and commercial administration and health and other relevant departments. Coordinate the leadership team. The leading group has an office located in the public security organ, which is specifically responsible for the organization and coordination of law enforcement linkage and other daily work.
Article 6 Breeders shall raise dogs in a civilized and legal manner and shall not harm public interests or the legitimate rights and interests of others.
Chapter 2 Division of Responsibilities
Article 7 The public security organs are the competent departments for dog breeding management and are responsible for dog registration, investigating and punishing unlicensed dog breeding, illegal taking of dogs out, and taking in unlicensed dogs. Host dogs and organize the capture of wild dogs and infected dogs.
The animal husbandry and veterinary department is responsible for dog immunization, quarantine and other related management work.
The comprehensive law enforcement department of urban management is responsible for investigating and punishing behaviors such as operating on roads, selling dogs without a license, and damaging city appearance and environmental sanitation, and assists the public security organs in investigating and punishing behaviors such as raising dogs without a license and illegally taking dogs out.
The industrial and commercial administration department is responsible for the supervision and management of dog business activities.
Health department heads use the administration of rabies vaccinations and the diagnosis and treatment of rabies patients.
Yang Guang, the Anci District People's Government and the relevant departments of the Langfang Development Zone Management Committee should do a good job in dog management based on the principles of convenience for the masses and ease of management.
Article 8 Radio, television, newspapers and other news media should do a good job in publicizing relevant knowledge on dog management and health and epidemic prevention laws and regulations.
Article 9 Sub-district offices, township people's governments, community residents' committees, and villagers' committees should carry out publicity, education and training for residents and villagers on lawful and civilized dog keeping.
Property service companies should assist community residents’ committees and villagers’ committees in the standardized management of dog breeding.
Article 10 Community residents’ committees, villagers’ committees, and owners’ committees can convene residents’ meetings, villagers’ meetings, and owners’ meetings to formulate conventions on matters related to dog breeding management in the residential area, and organize and supervise the implementation.
Chapter 3 Immunization and Registration
Article 11 Registration and regular quarantine systems shall be implemented for dogs raised in urban areas.
Article 12 Individual residents who apply to raise a dog must meet the following conditions:
(1) Have legal identity certificate (ID card, household registration book);
(2) Have full capacity for civil conduct;
(3) Have a fixed residence.
Article 13 Residents who apply to keep dogs are limited to one dog per household, and it is prohibited to keep large dogs and aggressive dogs. If the dogs bred produce puppies, the breeder shall hand over the dogs exceeding the prescribed number to others or send them to a dog shelter center within 90 days.
Animal husbandry and veterinary departments should solicit opinions from all walks of life through organizing hearings, demonstration meetings and other procedures, determine the specific standards and breeds of dogs that are prohibited, and announce them to the public in a timely manner.
Article 14: Individual residents who apply to raise a dog shall follow the following procedures:
(1) Before raising a dog, the resident committee or village committee of the community where he or she lives shall verify that the dog is being raised. Dog Condition.
If the dog-raising conditions are met, the community residents' committee or villagers committee shall issue a certificate proving that the dog-raising conditions are met, and sign a "Dog-Raising Obligation Guarantee";
(2) The breeder shall obtain the dog-raising certificate after obtaining the dog-raising certificate. Within 15 days from that date, take the dog to the immunity quarantine point established by the animal husbandry and veterinary department with the certificate for rabies vaccination and dog quarantine. After passing the immune quarantine, the animal husbandry and veterinary department shall issue an animal immunity certificate and an animal quarantine certificate;
(3) The breeder shall bring the dog with him and hold relevant certificates and household registration certificates within 10 days after the dog passes the immune quarantine. Go to the public security bureau to register your dog. The public security organ shall review the relevant certification materials submitted by the breeder within 5 days from the date of receipt of the dog registration application. If the conditions are met, a "Dog Registration Certificate" and a Dog Breeding License will be issued. Those who do not meet the conditions will not be registered and the reasons will be notified in writing.
Governments, groups and public institutions are prohibited from raising dogs or hiding dogs. If the army, scientific research institutes, hospitals, factories, warehouses and other units in the urban area really need to keep dogs for security, scientific research, testing, etc., they shall handle it in accordance with the prescribed procedures after obtaining the approval of the competent department according to the affiliation.
Article 15 The "Dog Breeding Registration Certificate" shall state the following matters:
(1) The name of the breeder or the name, address and contact information of the unit;
(2) The breed, photo and main physical characteristics of the dog;
(3) The dog’s immunity;
(4) "Dog Registration Certificate" ( Dog license) issuance time;
(5) Other matters that should be recorded.
Article 16 After the dog immunity period expires, the breeder shall take the dog to the immunity quarantine point established by the animal husbandry and veterinary department to receive rabies vaccination; every 6 months, the breeder shall take the dog to the animal husbandry and veterinary department established by the animal husbandry and veterinary department. Quarantine is carried out at the immune quarantine point.
Newborn puppies are vaccinated at 3 months of age, the second time at 12 months of age, and once a year thereafter.
The animal husbandry and veterinary department shall establish dog immunity files. If a dog is found to be sick or carrying a virus, the dog shall be detained on the spot and dealt with in accordance with prescribed procedures. The cost shall be borne by the breeder.
Article 17 If a breeder has any of the following circumstances, he should go to the place designated by the public security organ with the "Dog Registration Certificate" to go through the change and cancellation procedures:
(1) If the breeder's name, address, or contact information changes, the change registration must be made within 15 days from the date of change;
(2) If the breeder transfers or sells the dog to another person, the transferee shall Change registration should be handled at the registration authority;
(3) If the dog dies or goes missing, the breeder should go to the registration authority to handle cancellation procedures. If the dog owner has not gone through the cancellation procedures, he or she may no longer keep the dog;
(4) If the owner really needs to give up his dog for any reason, he must return the dog to the owner within 15 days from the date of delivery. reception center and go through the deregistration procedures with the registration authority.
Article 18 If a dog owner loses his dog registration certificate, he shall apply to the original registration authority for a replacement within 15 days from the date of loss.
Chapter 4 Code of Conduct for Dog Breeding
Article 19 Breeders or units shall abide by the following regulations:
(1) When taking dogs out of the house, Dogs should be led by adults, with dog tags hung on their necks, leashes tied and muzzled, and kept out of the way of the elderly, disabled people, pregnant women and children;
(2) Dogs are not allowed to enter the park , squares, public green spaces, commercial blocks, markets, shops, restaurants, schools, hospitals, exhibition halls, theaters, sports venues, libraries, community public fitness venues, playgrounds, waiting rooms and other public places; public * * * places Management units should hang prohibition signs in prominent locations and perform supervision and management obligations;
(3) Except for small taxis, dogs are not allowed to take public transportation; when taking dogs to take small taxis, they must Obtain the driver's consent and put a muzzle on the dog, or put the dog in a dog bag or dog cage;
(4) If you take the dog with you in the elevator, you should avoid the peak hours of the elevator. , put the dog into a dog bag, a dog cage or a hug;
(5) Keeping a dog must not interfere with the normal life of others, and the owner should immediately remove the feces excreted by the dog outdoors; when the barking of the dog affects the rest of others , the breeder should take effective measures to stop it;
(6) Regularly take the dog to the immunity quarantine point established by the animal husbandry and veterinary department to receive rabies vaccine injection and quarantine;
(7) No Abuse or abandonment of dogs.
Article 20 If a bred dog injures another person, the breeder shall immediately send the injured person to a disease prevention and control institution for injection of human rabies vaccine, and promptly send the injured person to a medical and health institution for diagnosis and treatment, and advance the medical expenses. If a dog injures another person due to the fault of the owner or a third party, the owner or third party shall bear all the medical expenses of the injured person and compensate the injured person for other losses.
Article 21 Dogs that have injured people or are suspected of having rabies shall be promptly sent to the dog reception center established by the public security organ, and the animal husbandry and veterinary department shall send an expert team for identification. For dogs diagnosed with rabies, the public security organs shall cull them under the guidance of the animal husbandry and veterinary department and conduct harmless treatment.
Units and individuals who discover rabies and other epidemics should promptly report to the animal husbandry and veterinary department or nearby disease prevention and control institutions and medical and health institutions. After receiving the report, the animal husbandry and veterinary department shall delimit the epidemic point and area according to the epidemic situation, and formulate emergency prevention and control measures. After receiving the report, disease prevention and control institutions or medical and health institutions should immediately take necessary measures such as epidemic control and patient treatment based on the epidemic situation. The public security organs should assist in relevant work.
Article 22 Units or individuals engaged in dog diagnosis and treatment activities shall obtain an animal diagnosis and treatment license in accordance with the law with the approval of the animal husbandry and veterinary department, and apply for registration with the industrial and commercial administration department with the animal diagnosis and treatment license. Only after obtaining a business license can you engage in animal diagnosis and treatment activities. Personnel engaged in canine diagnosis and treatment must have the qualification to practice veterinary medicine.
Units holding dog exhibitions should hold quarantine certificates for the dogs on display and go through relevant procedures in accordance with the law.
Article 23 It is prohibited to use, alter, forge, or buy or sell documents and certificates related to dog breeding.
Article 24 If a dispute arises due to personal injury caused by raising a dog, the parties concerned may apply for mediation to the local people's mediation organization, or may directly file a lawsuit with the local people's court.
The parties shall fulfill the mediation agreement reached under the auspices of the people's mediation organization.
Article 25 The public security organs shall establish illegal record files for dog breeding, and record breeders who have been reported or punished multiple times in the illegal record files.
Article 26: Public security organs shall establish dog reception centers to receive and handle dogs abandoned by breeders, confiscated dogs and ownerless dogs.
Dogs taken in by dog ??shelters established by public security organs can be claimed and adopted within 7 days from the date of admission; if they are unclaimed and adopted, they will be disposed of by the public security organs in accordance with the law; dead dogs should be left alone Pollution treatment.
Chapter 5 Legal Responsibilities
Article 27 Any unit or individual has the right to criticize or discourage dog-raising behavior that violates these regulations, or to report to the community residents committee or villagers If the committee or property service company reports, or reports to the relevant administrative departments, the community residents committee, villagers committee, property service company and relevant departments should handle it in a timely manner. For breeders who refuse to make corrections after being dissuaded, the community residents' committee or villagers' committee may apply to the public security organs to withdraw their consent to breed dogs, and the public security organs shall cancel their registration procedures.
Breeders who are recorded in the illegal dog-raising records by the public security organs will be prohibited from raising dogs within 5 years and their registration procedures will be cancelled.
Article 28 If a dog is kept without approval, the public security organ may temporarily detain the dog and order the owner to complete relevant procedures within a time limit and pay maintenance fees. If the relevant feeding procedures are not completed within the time limit, the public security organs will take care of it.
Article 29: Those who keep dogs or do not keep dogs in public places shall be detained or killed by the public security organs.
Article 30: Dogs raised on roads and other public places shall be removed immediately by the breeders. Those who violate the regulations shall be ordered to remove them by the comprehensive law enforcement department of urban management. Those who refuse to remove them shall be fined more than 50 yuan. A fine of less than 200 yuan is imposed.
Article 31 Anyone who raises dogs without an animal quarantine certificate will be given a warning by the animal husbandry and veterinary department in accordance with the "Hebei Province Animal Origin Quarantine Management Measures" and may be fined 1,000 yuan.
Article 32 If a dog interferes with the normal life of others, the public security organ shall give a warning in accordance with the "Public Security Administration Punishment Law of the People's Republic of China"; if a dog fails to correct itself after being warned, or if the dog is allowed to intimidate others, he shall be punished A fine of more than 200 yuan and less than 500 yuan is imposed.
Whoever drives a dog to harm others shall be detained for not less than 5 days but not more than 10 days, and shall be fined not less than 200 yuan but not more than 500 yuan; if the circumstances are minor, he shall be detained for not more than 5 days or fined not more than 500 yuan.
Article 33 If any staff member is prevented from performing official duties in accordance with the law, the public security organ shall give a warning or impose a fine of not more than 200 yuan in accordance with the "Public Security Administration Punishment Law of the People's Republic of China"; if the circumstances are serious, he or she shall be fined for not less than 5 days. If detained for less than 10 days, a fine of less than 500 yuan may be imposed; if the people's police are prevented from performing official duties in accordance with the law, they shall be severely punished; if a crime is constituted, criminal responsibility shall be pursued in accordance with the law.
Article 34 The administrative department responsible for dog breeding management and its staff shall conscientiously perform their management duties in accordance with legal procedures and enforce the law in a civilized manner. Anyone who commits any of the following acts shall be criticized and educated by his/her unit or the superior department; if the circumstances are serious, administrative sanctions shall be imposed; if a crime is constituted, criminal liability shall be investigated in accordance with the law:
(1) Refusal to handle dogs Registration, quarantine, immunization or deliberately delaying the time for qualified breeders;
(2) Failure to deal with or shirk the problems discovered during law enforcement inspections or reports received;
(3) Other acts of abuse of power, dereliction of duty, etc.
Chapter 6 Supplementary Provisions
Article 35 The funds required for dog breeding management shall be included in the financial budget for guarantee.
The standards for quarantine and immunization fees shall be formulated by the municipal price administrative department in conjunction with the municipal financial department in accordance with national regulations and announced to the public.
Article 36 The urban built-up area referred to in these regulations includes the main urban area, Langfang Development Zone and Wanzhuang New District that already have urban functions.
Article 37 The management of dog breeding in each county (city) may be implemented with reference to these regulations.
Relevant functional departments of the municipal government shall formulate specific implementation rules in accordance with these regulations.
Article 38 These regulations will come into effect on June 6, 2009. On September 13, 1999, the "Langfang City Interim Measures for the Management of Household Dog Breeding" (Langfang City [1999] No. 63) was abolished at the same time.
