What situations are eligible for legal aid?

According to the legislative spirit of laws, regulations and normative documents such as the "Legal Aid Regulations", legal aid recipients in my country refer to people who have the qualifications to obtain legal aid and actually receive legal aid.

The so-called qualifications for obtaining legal aid refer to meeting the following conditions:

1. Citizens of the People's Republic of China. Citizens of the People's Republic of China can apply for legal aid if they meet the following conditions:

1. Have sufficient reasons to prove that they need help in safeguarding legitimate rights and interests;

2. Have financial difficulties, Those who are unable to pay for legal services (the standards for citizens with financial difficulties are set by the government) have the right to apply for legal aid. (The standards for citizens’ financial difficulties are implemented by each locality with reference to the regulations of local government departments).

2. Blind persons, deaf-mute persons, and minors who are criminal defendants or criminal suspects and do not retain a defender shall obtain legal aid.

Other disabled persons and the elderly who are criminal defendants or suspects and are unable to hire a defense lawyer due to financial difficulties shall be provided with legal aid.

Criminal defendants who may be sentenced to death and have not retained a defender shall be provided with legal aid.

3. If a defendant in a criminal case of foreign nationality has not entrusted a defender and the people's court appoints a lawyer to defend him, he shall be given legal aid.

4. Legal aid applicants who have been reviewed and approved, or criminal defendants or criminal suspects who meet the conditions and are designated by the people's court, are the recipients of legal aid. During the legal aid process, recipients may be informed of the progress of legal aid activities; if recipients have facts proving that the legal aid organizer is incapable of performing their duties, they may request that the organizer be replaced.

V. If the recipient obtains greater benefits from the resolution of the case or matter requiring legal aid, he shall pay service fees to the legal aid agency.
