On August, 2065438 165438, the procuratorate initially found out that Zhang Xupeng took advantage of his position to help others in land development and project construction, and illegally accepted other people's property for a huge amount, which was suspected of accepting bribes. On the morning of April 22, 2005, the case of Zhang Xupeng, the former county party secretary of Shouxian County, who was suspected of accepting bribes and abusing his power was heard in public in Huaibei Intermediate People's Court, and his cousin Zhang Xugang was also tried in the same case for accepting bribes.
In the indictment, the People's Procuratorate of Huaibei City accused the defendant Zhang Xupeng of illegally accepting 5 million yuan from the project investor of Shouxian Branch of Zhongjingrun Real Estate Group Co., Ltd. together with the defendant Zhang Xugang by taking advantage of his position. In addition to taking bribes, Zhang Xupeng also illegally accepted a bribe of 6,543.8+0.5 million yuan from Hu Moumou, the chairman of Anhui Yongshun Real Estate Development Group Co., Ltd., in order to seek benefits for others. The procuratorate also accused Zhang Xupeng of abusing his power during his tenure as secretary of Shouxian County Party Committee, resulting in economic losses of 2.73 million yuan.
The defendant and his defense lawyer have no objection to the criminal facts accused by the procuratorate. During the court debate, Zhang Xupeng's defense lawyer suggested that Zhang Xupeng's crime of abusing his power constituted surrender, which could be given a lighter or mitigated punishment. Zhang Xugang's defense lawyer argued that Zhang Xugang's behavior only played the role of introduction and matchmaking, which should constitute the crime of introducing bribery.
In response to the appeal defense opinion, the prosecutor pointed out that surrender is a crime in which the criminal suspect voluntarily surrenders and truthfully confesses to the judicial organs. In this case, Zhang Xupeng was summoned to the case and did not take the initiative to surrender. The criminal facts truthfully confessed are the criminal facts that have been mastered by the investigation organ and should not be considered as surrender. In the crime of accepting bribes, Zhang Xugang is the actual agent of Zhang Xupeng, and both of them are the principal offenders.
During the trial, Zhang Xupeng did not defend himself and expressed his willingness to plead guilty in court. In the final statement, Zhang Xupeng deeply regrets that he failed to keep the bottom line of honesty and resist the temptation of money and embarked on the road of crime.
