Regulations of Hohhot Municipal People's Congress on Deputies' Work (1999 Amendment)

Chapter I General Provisions Article 1 In order to ensure that deputies to the Municipal People's Congress perform their duties according to law and play a representative role, according to the Organic Law of People's Republic of China (PRC) Local People's Congresses and Local People's Governments at Various Levels, Law of the People's Republic of China on Deputies to the National People's Congress and Local People's Congresses at Various Levels and Measures of Inner Mongolia Autonomous Region for Implementing the Law on Deputies to the National People's Congress and Local People's Congresses Article 2 Deputies to the Municipal People's Congress are members of the municipal state power organs, represent the interests and will of the people, and participate in the exercise of state power in accordance with the functions and powers entrusted to the Municipal People's Congress by the Constitution and laws. Article 3 Deputies shall perform their duties during and between sessions of the Municipal People's Congress. The state and society provide protection for deputies to perform their duties as deputies. Article 4 Deputies to the Municipal People's Congress must safeguard the people's congress system.

Representatives are equal in exercising their rights and fulfilling their obligations. Chapter II Rights and Obligations of Deputies Article 5 Deputies shall enjoy the following rights:

(a) to attend the meeting of the Municipal People's Congress, to consider various proposals and reports, and to vote on various resolutions and decisions;

(two) at the meeting of the Municipal People's Congress, have the right to vote and stand for election;

(three) during the meeting of the Municipal People's Congress, more than ten representatives may jointly submit a motion within the scope of functions and powers of the Municipal People's Congress to the General Assembly within the prescribed time limit;

(four) during the meeting of the Municipal People's Congress, more than one tenth of the deputies may jointly propose to recall the members of the Standing Committee of the Municipal People's Congress, the members of the Municipal People's Government, the president of the Municipal Intermediate People's Court and the chief procurator of the Municipal People's Procuratorate;

(five) during the meeting of the Municipal People's Congress, more than ten representatives may jointly submit written questions to the Municipal People's Government and its subordinate departments, as well as the Municipal Intermediate People's Court and the Municipal People's Procuratorate;

(six) when the Municipal People's Congress deliberates the bill and report, the representative may ask the relevant state organs, and the person in charge of the relevant organs shall attend the meeting to explain;

(seven) representatives may propose to organize a special investigation committee according to law, and participate in the special investigation committee according to the decision of the Municipal People's Congress or its Standing Committee;

(eight) when the Municipal People's Congress is not in session, representatives who account for more than 1/5 of the total number of deputies may propose to convene a meeting of the Municipal People's Congress temporarily;

(nine) to put forward suggestions, criticisms and opinions on all aspects of work to the Municipal People's Congress and its Standing Committee;

(ten) the speech and voting at the meeting of the Municipal People's Congress are not subject to legal investigation;

(eleven) without the permission of the presidium of the Municipal People's Congress, when the Congress is not in session, without the permission of the Standing Committee of the Municipal People's Congress, no arrest or criminal trial. If a person is detained as a flagrante delicto, the public security organ executing the detention shall immediately report to the presidium or the Standing Committee of the Municipal People's Congress;

(12) When the public security and judicial organs take measures to restrict personal freedom as prescribed by law, they should take the initiative to identify themselves as representatives, show their representative cards, and have the right to appeal to the Presidium of the Municipal People's Congress or the Standing Committee of the Municipal People's Congress. Article 6 Representatives shall perform the following obligations:

(a) study the constitution, laws, regulations and policies, establish the concept of socialist democracy and socialist legal system, and serve the people wholeheartedly;

(2) Abide by the Constitution, laws and regulations, keep state secrets and safeguard national interests;

(three) to publicize the national laws and regulations and the resolutions and decisions of the Municipal People's Congress and its Standing Committee;

(four) to attend the meeting of the Municipal People's Congress, to participate in the investigation and inspection of relevant issues organized by the Standing Committee of the Municipal People's Congress, and to participate in the activities of representative groups and representative groups;

(five) according to the arrangement of the Standing Committee of the Municipal People's Congress, to participate in the appraisal activities of the Municipal People's Government, the Municipal Intermediate People's Court, the Municipal People's Procuratorate and its subordinate departments;

(six) keep close contact with the original electoral units and people, listen to the opinions and demands of the original electoral units and people, and report to the Municipal People's Congress and its Standing Committee and the Municipal People's government in a timely manner;

(seven) to assist the people's government at the same level to carry out the work. Chapter III Representative Groups and Representative Groups Article 7 Deputies to the Municipal People's Congress are divided into representative groups according to the electoral units, and each representative group elects two convenors.

Each representative group can be divided into several representative groups, and each representative group elects two conveners. Eighth representative group activities at least once every six months; On behalf of the group activities at least once every six months. Article 9 The main tasks of the representative liaison group are:

(a) to convene a meeting of all representatives of the joint group to convey relevant documents and the spirit of the meeting;

(two) to convene a meeting of the convener of the representative group, listen to the report on the activities of the representative group, and study and deploy the work of the representative group;

(3) Organizing representatives to conduct inspections and investigations;

(four) to organize relevant representatives to comment on the motions, suggestions, criticisms and opinions of the Municipal People's Congress Standing Committee, the Municipal People's Government, the Municipal Intermediate People's Court and the Municipal People's Procuratorate;

(five) to reflect the activities of the joint group to the Standing Committee of the Municipal People's Congress.
